The Earth is called blue planet cause of the ocean, biological resources living in the ocean is perceived as fishery resources. With the development of the Industrial Revolution, the fishing technology is rapidly expanding at all times, the same as the marine fishery. As a result, marine fishery resources facing a danger called sharp cutoff and drying up. When a large number of countries are conscious of the threat, international fishery law began to develop, grow and improve. China is a maritime country with a poor fishery law. The provisions in fishery law cannot cover all kinds of fishery activities, the Departments of Fishery Administration always be restrained when executes the task. Unsustainable idea of development is a fault for marine fishery resources, and will lead to uneconomic consequence. Solving the problem needs to absorb the essence in international fishery law on the basis of national conditions and policies or creates new ways to improve the measures regarding conservation and management. So that the premise of sustainable development could be realized.
