Since China’s reform and opening up, the peasants’ income has increased significantly, appeared building spree again and again. Due to lack of planning and management of village land, many residential areas scattered overall arrangement and the built areas always overweight. Along with the rapid urbanization development, numerous peasants shift to the cities at present. Subject to the urban and rural household registry system and prudent system of residence land use, peasants tend to retain the original house sites, which making the extensive use of homestead. According to statistics, our country rural homestead is idle of 10% to 20%, Some regions as high as 30% so far. Therefore, in order to reinvigorate the existing, scarce land resource and relieve the the wasting phenomenon, it is necessary to realize the free right of transferring the homestead. However, there has been very little of real circulation behavior. And the urban and rural linking area where the behavior relatively active had so much legal form of invisible trade.The poor rural land circulation is related to the homestead law and policy in our country, as well as the microscopic factors of peasants’ level. Specifically, one of the important reasons is the residential land property rights system is not perfect. farmers with incomplete land property rights make that can not get good protection, so the further circulation motivation is ineffective. In order to promote the reform of rural land management system and realize land credentials tube, "No.1 document" of central government points out "speed up the rural collective land ownership and construction of land-use right contained homestead land cadastral survey, finish registration agencies work as soon as possible" in 2013. At the end of that year, our national rural collective construction land-use right and homestead use right registration had completed certification of rate of 72% and 78% respectively.In theory, homestead rights confirmation and certification benefit to determine and improve the peasants land, housing rights of possessing, utilizing, profiting and circulating in the form of law. Thus the homestead and housing assets value can be manifest. However, whether this design of property right system can affect the peasants’ willingness to land circulation in practice and behavior, it is depends on the farmers’ cognitive effects, and this will directly affect the performance of the property rights system reform. But there be less research in this aspect at present. Therefore, this study attempts to standing at farmers perspective and uses the peasants investigation data that from different natural geographical and economic location in Hubei province. The key to equaling effect of housing land use right for farmers will influence, so as to approval and housing land use right transfer system. To put forward some practical Suggestions on homestead confirmation and circulation, this research will explore the relations between farmer’s perception of homestead confirmation effect and farmers’ willingness to homestead transfermation.This paper mainly includes the following several parts:For reference and innovation the first part in this paper makes a literal review about domestic and foreign homestead right confirmation and transfermation on the basin of putting forward the research goal and approach.The second part, the article analyzes the effects of right, economy and society in homestead rights confirmation with the theory of property-economics after introducing general situation of study region and investigation sample. Then use descriptive statistics and correlation analysis to explore the peasants who from different natural, economic region cognitive differences about the effect of right confirmation. The forth part is the experimental study, in which of the impact of homestead rights confirmation and peasants’desire to homestead transfermation based on the theoretical analysis. In this part, peasants personal and family characteristics, the homestead characteristics and confirmation cognitive has been considered in use of logistic regression method.The study found that there are some effects of right, economy and society in homestead rights confirmation. However, the cognition of peasants in suburban areas, exurban areas and scenic areas in remote of city is different. Overall, the peasants in suburban areas and scenic areas in remote have a better cognitive to the effects of right and economy. However, in the social effect of cognition, exurban areas rural peasants behave more positive. In addition, the model regression results indicate that peasants’ cognitive to the effect of homestead confirmation housing has different influence of peasants household land circulation. The integrity of the property rights and economic benefits from homestead confirmation can strengthen the suburban areas and scenic areas in remote peasants’ willingness to transfer. But the further strengthening of homestead social welfare function after homestead right confirmation make the exurban areas peasants prefer to transfer homestead. Moreover, peasants’ age, education level, the ratio of income from non-agricultural employment, homestead area have a different effect significantly on their desire to homestead transfermation.
