On October 2013, Premier Li Keqiang visited Thailand and opened "high-speed diplomacy". Since then, government officials often spread CRH on important diplomatic occasions. CRH "going out" becomes a hot issue. However, the technology of CRH started late and entered a rapid development period since 2004, when CSR Qingdao Sifang and CNR bought advanced technology from Bombardier, Kawasaki, Alstom and Siemens with hundreds of million. Although CRH has made great achievements after more than ten years of development, China isn’t the technical power. CRH "going out" has to face a series of risks inevitably. We must carry out the construction of intellectual property(IP) early warning mechanism to avoid the risk of infringement right now. Patent which combines technique, economic, and business intelligence is the core of IP especially in the technology of CRH. Whom to not, rule on not chaos. Doing the study on early warning of Chinese high-speed railway from the perspective of patent is of great significance.Based on the research of patent early warning, IP management on railway industry and patentometrics, the paper establishes patent early warning mechanisms which is dominated by China Railway. Then we propose patent early warning based on patentometrics. The model does the analysis of overall high-speed rail industry, key technology areas, the main competitor and evaluation of the six country high-speed rail technology. The main contents are development trend, major countries, technology distribution, research institutions and high-value patent. We use entropy method for high-value patent and AHP for six high-speed rail technology evaluation section.The research shows that China’s R&D direction in the technology of CRH research consists with the technology development trend, mainly in station project, high-speed train and network control systems. But the patent quality are lower as most of them are appearance patents. The lack of high value patents will result in technical barriers. Enterprises do not pay attention to the patent layout overseas. These issues will cause a series of risks such as infringing patent disputes abroad, R&D repeat risk, technology investment risk and other risks directly or indirectly. Finally, the paper gives some feasible suggestions to deal with the risks from four aspects including patent mechanism construction, technology R&D direction, patent layout and international cooperation.
