As an emerging industry, network communication products have been incorporated into everyday life. US social networking website Facebook has been the most frequently-visited website for the past three years. In September 2014, its market value for the first time reaches 200 billion US dollars, overtaking IBM, Oracle and other famous technology companies, becoming one of the most valued companies in the world. In February 2014, Facebook use up to 19 billion US dollars to acquire the instant messaging application— WhatsApp. This action reflects the value behind such applications, which has caught unprecedented attention from the world market. Net communication products become a new economic growth point. It value lies in its unique intellectual property right.Since China joined WTO, the topic of intellectual property rights (IPR) has been an important research topic. IPR is an important indication of certain country’s strength. Hence the importance of IPR is obvious. The strategic role of IPR is increasingly important, while China lags behind in IPR development and the environment for IPR development is also not that satisfying. So further emphasis on IPR in China is required.With the development of network communications products, related topics are also increasing, especially in the area of the quantity, quality, protection of intellectual property right, etc. The United States, as the host country of the most comprehensive intellectual property protection system, and the leader in network communications technology in the whole world, will undoubtedly plays a reference role for Chinese net communication tools in the areas of products development and intellectual property right environment construction.This article starts from the analysis of the development of net communication products. Then based on the results of Chinese and overseas scholars’ research results, it further analyses the differences in law economy, education environment, and technology environment in China and the US. Also, it compares the intellectual development status from the angles of total amount, quality and innovation mechanism. After comparison, we can identify the unsatisfying environment in China. As for the development of IPR, although China has been the leader in total IPR amount, but the quality lags behind because its life cycle is short and technology it holds is not widely applicable. Then the paper use the examples of Facebook and Tencent as case study, during which SWOT analysis is adopted for comparing their intellectual property right strategies based on previous research results and shed light on the IPR development of Chinese net communication companies. Finally the paper points out the problem of China net communication products industry from the areas of quality, information exchange and IPR management and offers suggestions for both companies and government.
