With the development of economy and society,the status and importance of the small and medium-sized enterprises(SMEs)in national economy is unquestionable,and the SMEs take more important role in economical activities.Thought as a whole entity,the SMEs play an irreplaceable positive role in various sectors of economy,some detrimental behaviors to public social benefits occurs constantly,like damaging customers' right and interests,polluting the environment,infringing employee's rights,disturbing market administration order,etc.For example,In recent years it is often reported in the newspapers that some small and medium-sized enterprises damaged the interests of society and shirked or even refused to bear responsibility events,some small and medium-sized enterprises made use of the lack of legal norms to reap benefits regardless of their responsibilities.Which reflect the insufficiency of moral regulation and the necessity of legal regulation to social responsibility.It could be included from all those phenomenon that forming those SMEs with only moral limitation isn't enough,which makes the legislation of enterprise social responsibility essential.To legalize social responsibility,which is in fact more like a moral issue,seems very difficult.However,once we look over the both domestic and foreign legislature,the legalization of social responsibility has become acommon event by legislative,judicial and law enforcement,which makes the legislation of enterprise social responsibility workable.The social responsibility of SMEs refers to,in the pursuit of maximizing the interests for employers and shareholders,they should also bear the responsibility of different degree and different types at the same time.But because the weak basis and ability,the SMEs are not initiative in perform their social responsibility,Because of the lack of appropriate legal regulation specific to the SMEs,the SMEs have same responsibility as the big enterprises.The SEMs don't have relatively loose legal environment,and the slack law enforcement could lead to the difficulty in ruling them.Therefore,it's important to clear the principle of our principle on SEMs' social responsibility legislation,according to the principle,building the legislation system which put the company law as the basis and core,executing with different department law.Meanwhile it's important to provide the SEMs with relatively loose legal environment,enhance the help and encouragement from government,and establish a social responsibility evaluation standard for SEMs,then strictly enforce the law to regulating their behavior.
