Analysis Of Current Situation And Countermeasures Of Grassroots 12315 Administrative Law Enforcement

Ever since State Administration for Industry and Commerce of the People's Republic of China implemented 12315 consumers reporting and tip-off hotline nationwide, 12315 has been enjoying popular support gradually. After gradual completion, 12315 administrative enforcement of law relying on the hotline has entered a new development period. Domestic researches about 12315 administrative enforcement mainly lay particular stress on the integral progradation in provinces and cities, but there are few case studies of the grassroots frontline and it is even fewer for researches about grassroots frontline. Currently, market supervision structural reform has been carried out nationwide, This paper takes H District as an example, aiming at the supervision model of “two-in-one” of Administration for Industry and Commerce and Management of Food and Drug Administration in H District, 12315 administrative enforcement in the new period under new functions is studied. Besides, the functions, institution setting, staff composition, current status of work and relative procedures during 12315 administrative enforcement of Market Supervision Administration of H District are elaborated. Then, it gives detailed description and analysis aiming at reporting and complaint of online shopping, cracking down on fake products and excessive rights protection during law enforcement, concludes typical characteristics of 12315 work in H District and analyzes relative work difficulties. Through case summaries and analysis of current work status, problems in 12315 administrative enforcement in H District are analyzed from 4 perspectives, which are law enforcement, system, legal system and publicity; the problems are weal supervision forces, low staff quality, lack of department cooperation and so on. Aiming at the above problems, this paper refers to advanced experiences of 12315 administrative enforcement, combines the author's own work practice and proposes improvement measures from our perspectives, which are completing self-quality, completing law enforcement, completing department cooperation and completing social supervision.
