Study On The Industry Associations Undertaking Government Functions

Industry associations as Non-profit organizations playing an significant role between governments and enterprises. By undertaking government functions, industry associations taking participate in the industry-related administrative affairs, improving the administrative efficiency of government and the quality of service, promoting the deepening reform of administrative system. Currently, the research and practice of our countries' industry association are still in the preliminary stage, related theoretical research and system needs to be developed.Local governmens have been attempts the reform that industry associations undertaking government functions. The article took Shenzhen as a case, discussed the related issues that Shenzhen industry association undertake the government functions in three parts. Part one, combed the present situation and development history of Shenzhen industry association, summarized the main contents and methods, like industry management and coordination; social affairs service and management, technology and market services. The way of undertaking: transfer-alternative; commission-buy; authorize-subsidies. Part two, studied the operations of government supervision, focus on commission and buy. For industry associations undertaking government functions by commission-buy. The Current government regulation have been separated into three stages: Pre-supervision, Existed-supervision, Post-performance evaluation. By analysissing the way of undertaking, propose specific recommendations to problems in government regulation. Part three, discussed more on relief mechanism of industry association's clients. Since industry association possess executive authority by taking government functions, inappropriate behavior will have adverse effects on the interests of clients. The relief mechanism research is the foundation that guarantee the industry association undertaking government functions put into practice. Three methods to relief: internal grievance mechanism; administrative remedy; administrative litigation. Additionally, the article discussed the feasibility of social relief.
