With the rapid growth of economy and the progress of the society,the responsibility of a country has been expanding to social security system from the maintenance of social stability and public order and the role of country has turned into form of service.These provided the necessary premise for welfare administration development,subsistence allowances payment as an important content of welfare administration plays an important role in the state redistribution.Now,the stste council has carried out the basic living allowances system for urban residents,but has not had the complete laws and regulations for payment of living allowances.And the further expansion of the gap between the rich and the poor makes the perfection of living allowances payment becomes a reality demand.This article used the literature analysis and comparative analysis to throughout,and author will discusses from four parts:The first part analyzes the value and necessity of the urban low-income programs.Firstly,this part discuss the guarantee of due process to citizens'living right from two aspects:the control of due process to executive power and the guarantee of due process to parties.Secondly,this part analyses the four values of this program,and the fair pay,dignity,pay,performance pay and control to pay.Finally,this part discuss the necessity to improve the low procedures from the low program to control of the executive power,the program on the parties rights safeguard,cooperative-type new administrative relations and improve the administrative efficiency of the four aspects.The second part discuss the primary contents and problems about current low program of China.First of all,this part conclude that the current application system mainly concentrated in the application,investigation,evaluation and four aspects of the public by analyzing promulgated laws,regulations and rules,and summarizes.Secondly,through the analysis of the current program,it is concluded that the current drawbacks of low program in terms of legislative status and integrity has its.The third part analyzes the significance of abroad social security system to China.First of all,it is pointed out that since "fort DE v kelly"America focuses on the importance of due process of welfare administration,and analysis three application modes that professor Machaut analyzed from the American practice,namely the appropriate model,function model and the value of dignity.Secondly,this part analysis the characteristics of German administrative payment programm from the information provided,populist administrative behavior,the principle of due process and the principle of reliance interest.The fourth part put forward suggestions to perfecting our low payment procedure.First of all,Perfecting the legislation of produce of social security system.secondly,from the information release and the administrative organ provide advices for the parties to two aspects to perfect the information disclosure and teaching procedures;from the different application,start the program and the application deadline to prefect the application system.;perfecting review process from the authenticity of the application materials,preliminary investigation and survey program;improving the decision procedure from the payment deadline,listening t opinions reasons and publicity;improving exit and change procedures;from the beneficial perspective for parties,reconsideration and litigation put forward the improvement for relieving the low procedure.
