Study On The Dispute Resolution Of Extracurricular Counseling Service In Primary And Middle Schools

The service dispute of the primary and secondary school tutoring refers to the dispute between the educational consumer and the tutorship agency in the process of the educational service.Compared with other service disputes,the dispute in this paper has the following notable features.Its focal points are concentrated.The reason for the dispute is difficult to identify.The dispute's cycle is short,therefor it needs to be quickly resolved.The types of dispute are getting increasingly diversified.The litigants of the dispute are in the state of imbalance.The status quo of the dispute resolution is not satisfactory.Dispute settlement cycle is long,it hard difficult to meet the practical needs of resolving the disputes quickly.Litigation in preventing and resolving disputes in primary and middle schools extracurricular counseling strengths need to be discovered.Administrative mediation is difficult to play its advantages.Reconciliation is unfair,leading to the resolution of such dispute is not completed.Compared with other service disputes,education service recipient,who is a person with limited capacity for civil conduct,is involved in this kind of dispute.Therefore,the objective of resolving such disputes should include the protection of the recipient of education and the rapid and effective resolution of the dispute.In order to achieve the above goals and improve the current situation of the disputes,the author tentatively puts forward the following proposals.To tap the potential of lawsuit mechanism in preventing and resolving the disputes,the burden of proof should be reasonably assigned to both parties in judicial decisions,judicial advice and demonstration litigation system should be introduced to prevent potential disputes and resolve disputes effectively and quickly.Give full attention to administrative mediation,take into account the settlement and prevention of disputes.Make full use of court mediation to resolve such disputes quickly and efficiently.Promote the fairness of reconciliation,improve the credit evaluation system of counseling agencies to correct the imbalance between the two sides of the power of competition.
