Study On The Legal System Of Government Purchasing Community Public Health Service

How to realize the equality of life,solve the difficult,reduce the medical cost and even frequent medical violence incident,has become an important question.The community health service,which is one of the government responsibility,is beneficial to the people's livelihood.And the community health service as the public welfare services,is also a breakthrough in the reform of city medical service system from last century.The beginning of 80s,experts at home and abroad explored the feasibility of the practice of the public health service of community in China.Until 1997,article 8 of the CPC Central Committee and the State Council's decision about health service reform and development clearly points out that development of community health service has a great significance to the society's progress.However,there are still many legal problems in the government purchase of community public health service in our country.The local governments have made policies and laws,but these polices and laws are independent among others and lack of correlation.Moreover the effect of these local regulations or rules is relatively low.To some extent,these local regulations and rules hinder the reform process.Therefore,by studying the legal system of China's government purchase community public health service,helping our government further clarify the government purchase community public health service content,clear the purchase contract specification,purchase procedure supervision.The government purchase community public health service refers to that the government introduce the market competition mechanism in providing public health services instead of the tradition that the government provide public services directly,to meet the needs of the health of the population.On behalf of the public population,our government purchase the community public health services at competitive prices to meet the standards of social organization,by calculating the marginal cost of public health service,in accordance with established procedures.In this process,the government from the original providers,managers,supervisors and other roles in one body has changed into the macro-regulator,management,and the supervisor.The new government to provide public service mode includes a number of important contents,including the operation of the market,government commitment,directional commission,contract management,evaluation and other contents.The core of this paper is the legal system of government purchasing community public health service.By studying a large number of references,combined with the relevant laws of the central and the local regulations and laws,legal system of China's government purchase community public health service are studied.The first part is the introduction,an overview of the background of government purchasing community the public health service,the main ideas and purpose and significance of this paper.The second part summarizes the related theory of government purchasing community public health service.I analyzed the connotation of the concept of community,community health services and government purchase community public health service.Moreover the theoretical basis for community public health service was also analyzed.The third part describes the development of the legal system of China's government purchase of community public health services.I tried to point out the existing problems in the existing legal system.The fourth part is the foreign government purchase of community public health services legal experience and inspiration.This paper selected the United States,Britain.The two countries are relatively developed and their medical system is relatively mature,therefore they have rich experience and lessons in government purchase of community public health service.By analyzing the legal system of the two countries' government purchase of community public health services,combined to China's current implementation of the government purchase of community public health service,I try to explore the practical experience for our country,to promote the development of legal system of China's government purchase community public health service.The fifth part is about perfecting our country legal system of the community public purchase health service.According to China's current legal situation for the government purchase community public health service,summing up the practical experience of these years in our country and the existing problems,combined with the foreign practical experience of some developed countries to further perfect the legal system of China's government purchase community public health service.In addition,I tried to put forward some suggestions,in order to perfect the government purchase law and establish a scientific and reasonable performance evaluation system,deepen the reform of the medical and health system.
