Study On The Institutionalization Of Administrative Ethics

In the transition period of China,some administrative personnel have the ethical risk.In order to clear the value orientation of the administrative personnel,to guide the correct ethical choice,in addition to the moral self-discipline,heteronomy is needed,that is the institutionalization of administrative ethics.The administrative ethics is solved by applying the resultant force effect of the administrative ethical system in the article effectively,to guarantee the administrative personnel to realize the purpose of serving the people in their heart effectively.First of all,this article from the basic theory of the administrative ethical institutionalization,expounded the concepts of the administrative ethical system,analyzed the theoretical basis about the institutionalization of administrative ethics,discussed the relationship between the morality and the law,put forward an important point of view that administrative ethics can be institutionalized,contribute to realize the cooperation of “rule of virtue” and “rule of law”.Secondly,this paper elaborated the practical process of the construction of the administrative ethical system in the developed countries,analyzed the successful experience of the administrative ethical system in developed countries,put forward a sound administrative ethical legislation and independent administrative ethical regulatory agencies can reduce the administrative ethical misconduct effectively.Once again,this paper elaborated the construction of our country's administrative ethical institutionalization,analyzed of the administrative ethical system had made the achievements and shortcomings in China,discussed the reasons of the problems in the construction of administrative ethical system in our country,put forward to carry on the administrative ethical system should perfect the administrative ethical legislation and establish the special administrative ethical supervision organization.Finally,through the theoretical basis of the administrative ethical institutionalization,comprehensive consideration of the process of the administrative ethical system in our country and the successful experience of the construction of the administrative ethical system in developed countries,put forward that we must use both the administrative culture and administrativeethical system,that can be a full range of the administrative ethical construction,to prevent the administrative misconduct effectively.This article started with the problem of administrative ethics,and put forward the solution from the condition in our country.The comparative research method,the systematic research method and the cross disciplinary research method were carried on the deep analysis and research about the theoretical basis,the practical basis,the construction system and the countermeasure of the administrative ethical system respectively.
