Research On The Dilemma And The Solution Of The Petition System In China

Petition is the activities that citizens give information,make comments or suggestions to the people's governments at all levels and the relevant departments of the people's governments through correspondence,visits,and so on,which are dealt with by the relevant administrative departments according to law.The petition system forming in the early stage of the establishment of China,is a political system with Chinese characteristics.The petition system has played an important role in its development,which provides a system channel of opinion reflecting.Otherwise,it has achieved remarkable results in the consolidation of state power,the operation of the government supervision and the union of the masses.At present,as the social decompression valve and stabilizer,the petition system is still playing an important role on solving the problems and maintaining social stability.But the period of social transformation on the national economic system,the social organization structure,the existing pattern of interests,the conception of citizens,make the social contradictions in this period complicated and multiple.As an important way to resolve contradiction,the petition channel receives a large number of problems,especially the land acquisition,labor and social security,education,medical treatment,enterprise restructuring,environmental protection etc,challenging the work ability of petition departments Some local governments are still harming the interests of the masses in current,and some local petition departments also work at random,and some petitioners' legal concept is still weak,leading to a serious petition period.Facing the new situation,the petition system has been showing signs of maladjustment and gradually into the development dilemma.Thus,some people made a lot of criticism and accusations on the petition system,and even said it should be abolished.With a history more than 60 years,the petition system should not be easily denied,but be reform actively.Since the 18 th CPC National Congress,the central government' active exploration,such as petition according to law,Stripping of litigation,online petition,the petition with responsibility,provide an important direction for the petition reform.Based on the theory of institutional change and cooperative governance,this thesis analyzed the related concepts and the development of the petition system,studied its dilemma and reasons,then with the current central petition reform instructions,explored the measures breaking the petition plight.Preliminary study showed that the petition system has been caught in a number of difficulties: Petition function dilemma,Petition rule of law,Petition system difficulties,and petition case difficulties.Further study showed what lead to the petition dilemma are the design flaws,the lag of legal system construction,the imperfect national relief system,as well as unhealthy petition culture,etc.Therefore,the petition system reform should focus on correcting the work misunderstanding,improving the petition legislation,clarifying the petition functions,integrating the petition cases,exerting the role of petition mediation and online petition.In order to solve the plight of the petition system,we need for the country's top-level design,the pushing from the central,the reform plan as a whole,so as to overcome the structural and institutional drawbacks,and avoid the partial and short-term nature of local reform.
