On Public Participation In Local Legislation

China has established a complete set of socialism system filled with Chinese characteristics during several decades after the founding of People's Republic of China,which has gone through several stages to form the current system.With the enactment of a series of laws and regulations,such as legislative law,the whole legislation system has been effectively improved and public participation in legislation has also been promoted.According to specific pattern and development trend of society,various governments have summarized different systems and accumulated some experience of local legislation.But it is still quite difficult to legislate in the future because of the change oflegislative law,the expansion of local legislative power and the problems,having not been solved before,in local legislation.The first part introduces the research background and research statusof public participation in local legislation.The second part explains the concept of local legislation and public participation,and on this basis,it illustrates the theoretical basis,basic value and basic requirements of public participation inlegislation.The theoretical basis includes the theoryofpopular sovereignty,participatory democracy and consultative democracy;basic value includes the following three aspects:intensifying scientific and democratic legislation,strengthening the supervision of local legislation and improving awareness of the participation and legal accomplishment of citizens;basic requirements are scientific legislation and democratic legislation.The third part makes an analysis of the status of public participation in local legislation in China and divides it into three stages---initial stage,development phase and improving stage.It expounds the influence of publicparticipation in local legislationfrom political democratic system,developing conditions of economy and traditional culture.The fourth part,it proposes the problems existing in the process of public participation in local legislation from participants,platform construction and system construction.The fifth part makes reflection on how to improve the public participation in legislation,providing guarantees for it by expanding the scope of participants,improving the platform of public participation in local legislation and perfecting the system of public participation in local legislation.The establishment of legislation system isn't achieved overnight,but a long,continuous and gradual process,which requires us to think and innovate constantly.
