Although the logistics industry in China started late,but it developed rapidly,and considered to be the most development potential and the most valuable industrial sector in twenty-first Century.Due to the complex nature of the logistics industry and the confusion of the laws and regulations of the logistics,the development of the logistics industry is still in the state of spontaneous blindness and disorder.In 2014,the State Council issued the<Logistics Development and Long-term Planning(2014-2020)>,clearly pointed out that between the rapid development of logistics industry in our country,the legal system is very chaotic,causing the market order is not standard,the development of the logistics industry is affected by.Although China is accelerating the legislative work of the logistics industry,but the current logistics legal system is still not perfect.Because of the logistics industry involving the problem of cross sectoral and trans regional and multi link,the corresponding legal norms are more complex.However,China does not exist a unified logistics legislation,leading to the situation that current logistics legislation in our country decentralized,the system is not strong,and many legislative gaps existed.Therefore,it is urgent to develop a logistics law that can integrate all the laws and regulations of the logistics and coordinate the overall development of logistics.In 2009,the State Council issued the<Logistics Industry Restructuring and Revitalization Plan>,pointed out that "the perfect logistics system of policies and regulations,further research of relevant policy to promote the development of modern logistics industry" is the current stage of the policy measures which should be taken to.In 2014,the<Medium and Long-term Planning of Logistics Industry Development(2014-2020)>was also put forward the policy measures of "selecting the research and development of the logistics industry to promote the laws and regulations".Under the background of the times and the policy guidance,it is an urgent task to study and formulate a programmatic law which is in line with China's national conditions and plays a guiding role.In this paper,starting from the relevant concepts and development process of logistics,combined with the characteristics of the logistics industry integrated,integrated and integrated,the necessity of constructing logistics promotion law as a programmatic law is derived.Then,the definition,characteristics and function orientation of logistics promotion law are defined.At the same time,relevant legislation concepts and purposes of logistics promotion law are defined as the basic conditions for the legislation of logistics Promotion Law.After defining the basic concepts,this article focuses on the course and experience of Foreign Logistics legislation,and makes evaluation analysis accordingly,as a reference and reference for China's logistics promotion law.In order to achieve the purpose of legislation to promote the development of logistics,and the integration of the logistics industry logistics laws and regulations,this paper on China's logistics policies and regulations were analyzed and summarized the existing problems of the development of China's logistics industry,in order to improve and solve the logistics promotion law,really play its leading role of law.The last part is the author's legislative conception of logistics promotion law.By establishing the leading legal status of logistics promotion law,we can achieve the unity of comprehensiveness and specialization of China's logistics legislation.In the specific contents of construction,the author mainly from the perspective of the government,planning supervision,support,encourage the three level as a framework for discussion,from the establishment of logistics development planning,rational planning of logistics infrastructure construction and strengthen the logistics market supervision three aspects clear government in the logistics planning and regulatory functions;tax preference to encourage the development of logistics system and promote the development of logistics land policies as a government support to the development of the logistics industry;logistics and green logistics informatization construction around two major themes,the implementation of the government in the development of modern logistics incentives.
