Logistics is an integrated industry with transportation, storage, loading and unloading, processing, distribution and information, etc, which has been greatest developing potential in the world nowadays. Chinese logistics industry is a little behind the international averaged level with traditional service scope, poor mechanic operation, deficient software and limited functions, which leads to inferior competition ability in the international market. Logistics industry managing many fields and nods, laws concerned disperse among different kinds of laws that are legislated by different divisions of the government for respective needs, which results in disunity, inconsonance and poor operation. Moreover there are quite a few issues concerning logistics unlegislated by professional logistics laws.Logistics industry is the key for Chinese national economy to transform from the extensive to the intensive. However poor logistics legal system at present of China is the bottleneck. That means the government should build a logistics legal system with justice, clarity, uniformity and efficiency that benefit enterprises' promoting competition ability. Particularly after the entry of WTO, China should study how to protect domestic logistics industry without any offence of WTO rules.With a comparison about logistics legal system between domestic and overseas, the paper studies existing problems of logistics industry of China, focusing on some fundamental issues on legislation of logistics laws in China. In conclusion the paper provides some advice about how to improve Chinese logistics legal system to be more integrated, concord and suitable to Chinese realities and WTO rules.
