At present,in China's commercial economy,supermarket chains are an important part of national economy.Because of the influence of market structure system,the monopoly phenomenon of supermarket chains is becoming more and more serious.Because chain supermarkets occupy the terminal market sales channels,convenient geographical location,mature business circles and large-scale stores,in the zero-supply market occupies dominant position.Supermarket chains by abusing their possession of the dominant position of the market chasing the interests of normal business outside,specific behavior has indiscriminate access fees,limited prices,unreasonable occupation of suppliers of funds,as well as other a series of improper means to profit.These monopolistic behaviors not only make the supply and marketing contradiction between the supermarket chain and the supplier,but also injure the chain supermarket competitors ' interests and consumers ' rights,destroy the fair competition of market economy order maintained by the Antimonopoly Law.This article takes the chain supermarket buyer's monopoly behavior to involve the legal question as the main content,through the real life occurrence concrete case for guidance,carries on the analysis from the following aspects:First chapter,first to two a case starts with raised out chain supermarket abuse market dominated status behavior led to conflict of phenomenon between retailers and suppliers,then analysis chain supermarket market dominated status formed of reasons and the on social fair competition by caused of against,as which received channel fee,and long-term occupied dealer payment,aspects,according to China anti-monopoly method,obtained on its abuse market dominated status of behavior be legal regulation of need.The second chapter,consequences for the supermarket buyer monopoly,from the perspective of antitrust law was both positive and negative effects of analysis,analysis of suppliers,supermarket chain of the negative effects of competition,consumers and final analysis of the European Union,the United States and other countries on the dominant market position of the identification and definition of abuse of a dominant market position.The third chapter,first analyzed the supermarket buyer's monopoly of the four elements described supermarket chain of abuse of a dominant market position in violation of prohibitory provisions of antitrust law,specifically including: channel fee charging unreasonable price restrictions,discriminatory treatment,vendor payment arrears,according to the harm caused by its targeted regulatory measures is proposed.The fourth chapter,through the supermarket buyer's monopoly in China China's lack of legal regulations,penalties regulation principles,light,multi-sectoral joint law enforcement lead to inefficiencies.Finally,according to supermarket buyer's monopoly on some problems in the practice proposed referential integrity recommendations.
