Recent years,Due to the political turbulence,inner war,and religion conflicts in West Asia and South Africa,the number of asylum seekers surges sharply in Europe,which uncovers the instability and vulnerability of the common European asylum law system.EU has the experience of dealing with refugee before.Before the Refugee Crisis,a common asylum law system has been already built in EU.First after the signing of Shengen Agreement,some Shengen countries include Germany have realized the importance of safeguarding the outside border.Confronting the needs of border protection,EU members signed the Dublin Convention,which is designed to standardize the asylum application procedure and raise efficiency in 1985.The Maastricht Treaty signed in 1992 is another milestone of EU's cooperation in the field of internal affairs and justice.Maastricht Treaty has clear and definite the refugee and migration problem into EU's third pillar cooperation.However,EU's common asylum law system fails to function properly during the 2015 refugee crisis.The reason of its dysfunction roots in both member states and EU layer.As to the member states layer,the disproportionate share of refugee caused by geographical location as well as the change of domestic political environment lead to states' different attitudes toward the common asylum law system.As to EU layer,the obscure power division between member states and EU,the unbalanced organization structuring so far as to the identity ambiguity of EU cause the failure of the common asylum law system.The outbreak of refugee crisis is a great challenge to EU while it is also an opportunity for the political elites to find a way forward.
