A Study On The Legal Issues Concerning The Supervision Of Pension Institutions In China

The 2016 statistical bulletin of national economic and social development of the National bureau of statistics of China issued on February 28,2017 pointed that the total population of Mainland China was 1 billion 382 million 710 thousand by the end of 2016,and the population of 60 years of age and above was 2 billion 308 million 600 thousand,which was 16.7 percent of the total population.The population of 65 years of age and above was 150 million 30 thousand that was 10.8 percent of the total population.The rapid growth of the elderly population made the growing demand for pension,and the pension issues become increasingly urgent.However the cause of aging in our country is still difficult to meet the needs of the rapid development of population aging at present.The rapid development of the socialist market economy and the sociality of the pension gave birth to the pension industry.The institutional endowment has become one of turban pension mode to choose for the people,and it plays a very important role in order to make up for the defects of family pension and realize the social pension.For the moment,there are two main attributes of pension institutions in China,and one is the public pension institutions mainly organized by the government,another is the private pension institutions.An increase in the number of pension institutions alleviated some of the pressure on government pension services to some extent,but the pension institutions in the development process is still facing many problems at present due to the late development of China's service system So many problems restrict the healthy development of China's pension institutions.Therefore,it is vital for the healthy development of pension institutions to improve pension institutions related legislation,increase supervision of pension institutions and give full play to the different social responsibility of different pension institutions,and it is also conducive to China's active response to the aging of the population of this social problem.In this paper,according to the thinking of the problem,analyzing the problem,solving the problem,and based on the literature about the supervision of pension institutions,the author puts forward some law suggestions and countermeasures to improve the supervision of pension institutions in ChinaIn addition to the introduction and conclusion,the thesis consists of four parts.The first part is the problems existing in the supervision of pension institutions in China,which mainly set from four aspects: The legislation and policy of the pension agency supervision are flawed;The establishment and function of the supervision institutions are unreasonable in the laws and regulations;Inadequate supervision of the use of funds for public pension institutions in the law;There is a lack of legal provisions on the supervision of the quality of service of the pension institutions.The second part further analysis the reasons for these problems exist in China's pension institutions in many ways.It is a lack of specialized legislation on the supervision of pension institutions in China.The regulations on the provisions of the pension institutions of the laws and regulations are single.The classification management system of pension institutions in China has not been established yet.The management system of public pension institutions in China is rigid and lack of a unified national pension service quality standards and evaluation system.The third part mainly analysis the legal system of extraterritorial pension institutions supervision with comparative study method include the strict legal system of pension institutions in Japan,comprehensive service quality supervision in the United States,classified supervision system of pension institutions in German,the supervision system of pension institutions in Singapore,government responsibility in the supervision of pension institutions in Sweden and the pension institutions supervision in Hongkong,and Taiwan areaIn the last part,I put forward some law suggestions and countermeasures to improve the supervision of pension institutions on the basis of the first three parts by perfecting the legislation of pension institutions supervision in China,establishing the responsibilities and coordination mechanisms of the regulatory authorities,establishing and improving the diversified supervision approach,strengthening the supervision of the pension funds and service quality and the establishment of the classification supervision system of pension institutions.I hope to provide effective suggestions for the effective supervision and healthy development of China's pension institutions.
