With the development of the catering industry,food waste has become a common problem that the whole society has to face.Some scholars propose views different from the current local legislation based on the concepts of food waste.They argue that the food waste should include people's daily food waste from kitchens.However,from the perspective of laws and regulations regarding food waste,because of different ways of regulation,this paper excludes people's daily food waste from the concept.As random disposal of food waste can bring great harm to people's health,environment and city appearance,we must strengthen laws and regulations regarding food waste and the legal obligation of government according to laws so as to reduce the negative effects of food waste and promote the further development of circular economy.Relevant legal systems of food waste with local characteristics have taken shape in some developed countries,setting good examples to China.In China,legal system of food waste is still at the early stage without unified state stipulations.Besides,there still exist obvious problems in laws and regulations concerning food waste,such as lack of strict enforcement of waste clarification system,unified collection,disposal and transport regulations and transparent information of food waste,unreasonable charging system of food waste,poor supervision of the government and unscientific liabilities of food waste management.Therefore,it is hoped that a unified Regulations on Food Waste Management will be launched.Furthermore,through optimizing waste clarification and management,regulating the collection,transport,and disposal,achieving the comprehensive disclosure of transparent information about food waste disposal,specifying reasonable paid collection standards,strengthening law enforcement and unifying scientific liabilities of food waste management,food waste control will become more law-based.
