Since the reform and opening up,China has entered a new era of rapid economic development.Economic development has made China's overall strength proud and its international standing has become important.In the 90 s because of the economic development,urban and rural dual system boundaries become blurred,more and more farmers in order to improve their economic condition choose to urban migrant workers,for our country's economic development has made a great contribution.However,due to the imperfect of national policy and the limitation of their own conditions,rural migrant workers in the process of farmers to most farmers keep their children in the countryside,and they live apart,the resulting left-behind children also.In the past,there have been a number of studies on the group of left-behind children in rural areas,such as ethical issues,education problems and psychological problems,as well as crime.Was reported in 2015,the number of and protection of the rights and interests of rural left-behind children crime and case,rural left-behind children once again pulled into people's field of vision,the party and state to give attention to this.As the successors and builders of the future of the motherland,the rural left-behind children will be able to grow healthily and relate to the future of the country.The data referred to in this article is the opportunity to use the summer vacation internship to collect the judgment documents of a district court in Jinan for nearly three years.The main body of this article is divided into four parts.The first part is the definition of left-behind children in rural areas.In this section,the article defines the crime of left-behind children and left-behind children in rural areas.When defining the rural left-behind children,mainly rural left-behind children in academia defined standards and the ministry of civil affairs in a baseline screening work mentioned in the definition of standard after comprehensive comparison,and difference in the definition and general minors,summarizes the understanding of the concept of rural left-behind children: rural left-behind children is because one or both parents to go out for a long time and is left in the countryside,rural by raising for one of the other elders or parents in the home under 18 rural household register of minors;In the rural left-behind children crime definition,a combination of punishment and crime to learn about the relevant provisions of the minor crime,it is concluded that rural left-behind children crime refers to one or both parents to go out for a long time working,but left their children in rural life,learning,and the father or the mother side,grandparents,other relatives and friends and peers home elder guardianship of minors under 18 years old rural household registration by has serious social harmfulness and should be punished.Secondly,the status and characteristics of the crime of left-behind children in rural areas are analyzed.First collected in 2014-2016 verdict documents to obtain the corresponding data,in contrast the general minor crime and data analysis made on the basis of the number of rural left-behind children crime,crime types,crime,crime age composition and crime personnel by the reality of education degree,and then on this basis further concludes that rural left-behind children age,group crime is reduced,the individual characteristics of rising crime rates.Thirdly,the cause of the crime of left-behind children in rural areas was analyzed.The conclusion of the reason of the crime is mainly derived from the volume that I investigated.From rural left-behind children crime convicted former investigation material that rural left-behind children crime is so due to the concept of legal system imperfect,lack of care and convicted former survey and other reasons,so the author also focuses on the aspects of reasons for this.The fourth part is to prevent the crime of left-behind children in rural areas.This part of the strategy is based on the reason of the crime.Countermeasures mainly from the detailed laws and regulations,perfecting the judicial prevention and other preventive measures three aspects are discussed,combined with suggest refinements of the existing laws,and judicial Suggestions,etc.
