Research On The Process Of Charity Law Making From The Perspective Of Multiple Streams Theory

With the development of our country's economy,interest groups are gradually divided and formed a new social structure,which makes domestic philanthropy face more complicated social relations.Since the "Guo Mei-Mei incident" in 2011,the negative news of charity has appeared frequently,which has seriously affected the development of charity and the social credibility of charitable organizations.On one hand,the charity enthusiasm of the public is getting higher and higher;on the other hand,there are many problems and deficiencies in the development of charity,the most important and crucial point is lack of the legislative protection.The government,as a social manager,should assume the responsibility of charity legislation and provide legal protection for the development of charity.Charity Law has a long and tortuous process from proposal to publication,which is worthy of academic research.This dissertation based on the multiple streams theory,study the formulate process of the "Charity Law",and obtain some experience and enlightenment from this research.The main part of this paper can be divided into three parts.The first part introduces the content of the multiple streams theory and the applicability of the multiple streams theory model for studying the development of "Charity Law",such as the frame of the theoretical model,the contribution and the defects of the theory,and the applicability of the multiple streams theory,etc.In the evaluation of the multiple streams theory,the author believes that the contribution of the multiple streams theory to policy research can't be ignored.But its limitation is also obvious.The limitation of the multiple streams theory analysis lies in its unpredictability of policy.The applicability is used for analyzing the necessary conditions of the multiple streams theory analysis in the process of making "Charity Law".The second part uses the multiple streams theory framework to analyze the process of formulating the"Charity Law" from three sources and political window.It mainly analyzes the main components of the three source streams and the trigger mechanism that opens the window of policy.In this part,in view of the research conclusions of most scholars,the author believes that the three major streams of the development process of Charity Law are mutual influence and have a certain order.Among them,the stream of the problem and the stream of policy have a cross-development,they also have an impact on the policy stream and realizes the confluence of the three streams.The third part is the affective factors of the introduction of the Charity Law.It is also analyzed from the perspective of three sources and political window,In the analysis,we can see that the influential factors in the process of making charity law come from the different commonweal ideas of charity and the conflict of interest groups.The fourth part is the inspiration for China's policy making.In this part,the author gives some policy implications from the analysis of the influencing factors in the preceding part of policy making.Finally,the conclusion of the study is obtained by synthesizing the above analysis.
