Research On The Construction Of The Negative List Mode Of Government Management In Colleges And Universities

Since the reform and open policy, our country's higher education has made great progress, but to higher education in the developed countries of the world, higher education in our country is still relatively backward. All sorts of problems emerge in endlessly, especially in government management of colleges and universities,outstanding problems that are lack in macro management of the government, too much in the micro level intervention, which is mainly due to dislocation of the government management, the power of the government is unconstrained, to take comprehensive management of colleges and Universities, performance to the positive list mode, resulted in limiting the autonomy in running a university. Solutions is to correct the dislocation of government management, namely in government management of the universities, for the government power( public power) with a positive list of management mode, with a negative list management mode for the rights of universities( private rights).In terms of policy, the Third and Fourth Plenary Session of the 18 th CPC Central Committee, clearly put forward requirements of deepening reform, streamlining government and delegating authorities and governing the country by law, and implementation of negative list management model in the economic field. Since the implementation of the negative list of China FTA since 2013, has made gratifying achievements. Correspondingly, in the field of higher education, the government's management of colleges and universities is also mentioned in the relevant policies to implement the negative list mode, but the specific top-level design and practice is still in the exploratory stage.This study is in order to construct the negative list mode about the government management of colleges and universities. After reading a lot of literatures about government management of colleges and universities, FTA negative list, and sorting out the relevant policies and regulations, I bring out that the negative list of mode of the government management of colleges and universities follow the "All is permissible unless prohibited", which on the one hand draws the limits of authority between thegovernment and the colleges and universities, on the other hand gives the huge space for autonomous school running. On the basis of university autonomy and academic freedom,governance and good governance theory, comparison with the higher education in the United States about experience in government management, then construct the basic framework of the Chinese government management by the negative list form. And the main points of implementation are described, and points out that the related reform measures must be in place prior to the release of the negative list, the government power list must be with the negative list released at the same time, the third party intermediary organizations need to be built without delay, and the relevant laws and regulations also need timely to be to be revised and improved. Finally, the obstacles of the government management of the university to the negative list mode are analyzed from three aspects of government, universities and society, and put forward the way to crack.
