On The Administrative Delivery System

In our administrative legal system, the theory of service delivery is less concerned and the development is lagging behind. In practice, the delivery of administrative procedures is based on the provisions of the "Civil Procedure Law" in the delivery system requirements. However,administrative service and judicial service both in theory and in practice,there are significant differences, blindly in accordance with the "Civil Procedure Law" for the implementation of the provisions of the judicial service, to a large extent increased the cost of delivery, Reduce the efficiency of delivery, and China's administrative law in the principle of efficiency contrary.Administrative service is one of the important links in administrative act. It is related to whether an administrative act is lawful and effective. Therefore, the theory of administrative service as an important part of China's administrative law theory should be independent of the theory of judicial service, and the specific problems in administrative service should also focus on the current administrative law practice. The existing delivery theory needs to be further deepened and reformed.This paper is divided into five chapters. The first chapter analyzes the concept of administrative service from the aspects of connotation and denotation, and expounds the basic elements and value orientation of the administrative service system. The second chapter to the fifth chapter are the object and content of the administrative service, The way and the effectiveness of the four aspects of the analysis, each chapter in the logic of the argument, the first by the implementation of administrative service to start the status quo, both central and local legislation, including administrative practice and judicial practice in the practice Situation,combined with the relevant judicial case study, summed up the common problems in practice, and finally put forward the corresponding solution.
