On The Status Quo And Improvement Of The Property Declaration System Of Public Officials In China

The property declaration system is not unfamiliar to us.Its effect on the prevention and control of corruption has been well received in many countries and regions.Compared with Western countries,China's public property declaration system started late and was proposed in the late 1980 s,but it has not been greatly promoted.Under the current anti-corruption environment,traditional anti-corruption measures have been difficult to effectively curb the deterioration of the corruption problem.Only by constantly innovating the anti-corruption system and relying on institutionalized anti-corruption can we truly achieve the goal of anti-corruption.From the "Regulations of leading cadres reporting individual matters" and "Measures for handling results of reports relating to individual leaders of leading cadres",we can see that the system for the declaration of property by public officials in our country has begun to act,but there are still many outstanding problems.It is worth our excavation and improvement.However,first of all,we must make clear that the property declaration system is not legalized in our country,and we cannot independently achieve the role of preventing corruption.Only in the systemic comprehensive supervision system formed by other anti-corruption support measures can we exert its important anti-corruption and anti-corruption role.Therefore,this article starts from the basic issues.The article elaborates on the basic concepts and basic elements involved in the public property declaration system and guarantees the research direction.At the same time,it discusses the course of development of public officials' property declaration system,and discovers and discusses the problems that exist among them.Through analyzing the reporting subject of the property declaration system,the scope of application,and the undeclared punishment measures,the constituent parts of the property declaration system are studied.Then through analysis and comparison of the property declaration system of Japan,the United States,and Hong Kong,China,the problems existing in the existing property declaration system in China and the direction of development are derived.At present,the challenges and opportunities of the property declaration system for public officials in our country coexist.Judging from the social environment,public officials generally have a resistance mentality;from the perspective of legislation,there are no mature laws and regulations to support;from the perspective of the system itself,there are flaws,the reporting body is not clear,the scope of the property is not clear,the acceptance agency is not responsible Clearly,from the perspective of supervision,there is no effective supervision mechanism and corresponding accountability mechanism;and the corresponding supporting management system has not been perfected,and the financial real name system has not been established comprehensively.The author of this article thinks that the property declaration system must firstly improve the construction of the legal system for public property declaration from the legislative level,determine the specific scope of the subject and the property of the property declaration,accept the agency to be unified,and need a scientific and reasonable reporting time limit to determine a reasonable public notice.Content and time,clear penalties for false declarations.The declaration of property is neither a new-born calf,nor an exotic seed that cannot germinate on the soil of our rule of law.We will neither completely copy nor stand still.We have been working hard to see hope on the road to anti-corruption operations.Since the party's 18 th National Congress,the Central Government's determination to combat corruption has been beyond doubt and the anti-corruption work has continued to maintain a high pressure.As an important measure of anti-corruption,the property declaration system is particularly important.The system is based on the provisions of national laws and regulations on the property and income of specific people.It is not our country's original system to demand a system of truthful declarations.As early as 1766,Swedish citizens had the right to view general public officials until the prime minister's tax payment list.In 1883,the British Parliament passed the “Purification of the Election and Prevention of Corruption Act.” This is the world's first law on property declaration.Since then,many countries have successively established the property declaration system,which has also become the basic system and international practice for effectively regulating public officials.
