Along with the advancement of education democratization process, the education fairness has been the core theme attended by more and more people. Education fairness has different forms, from the perspective of education subject, teachers and students can be divided into fair justice. "Irregular teachers" as a kind of composite outsider, as their various rights and interests damaged, they are attended by more and more education researchers. At present, the study of "irregular teachers" has a lot, but the content of the research is relatively general, research angle and the method is single. Based on this, this study will focus on the rural side lack of teachers' rights.Here "rights", on the basis of the teacher's six rights are advanced in 1993 "pedagogic law" namely the right of education teaching, scientific research and academic activities, the right of management right of students, the right to paid treatment, the right to participate in democratic management and professional training. By comparing irregular teachers with regular teachers in rural areas and irregular teachers in urban areas can determine the rural side out the lack of what respect the rights of teachers, and to explore the reasons behind it.This study first combs the development course of irregular teachers in countryside including the formation period of the irregular teachers, the period of the consolidation and expansion, contraction period. In such a context, the researcher traced the research of the development of irregular teachers experienced including four types, namely the formation and dissolution of a substitute teacher and private teachers period, the emergence of new and old contract teachers and metamorphosis,formation and transformation of sending teachers, the birth and development of the new substitute teachers. At present, the schoolOnly has two types of irregular teachers, including sending teachers and the new substitute teachers . Sending teachers is unique to the school in the county phenomenon, which is not typical. So the new substitute teachers are the main research subject in this study.After clearing the research object, comparing the rights of irregular teachers with the regular teachers in rural areas, we find they have the problem of the major and disciplinary mismatch, cultivate and harvest disproportionate, and ability to ascend without the support, which means rural irregular teachers in teaching treatment options, remuneration rights, democracy having a lack of right of management and professional training,etc. Through to the rural side and comparison between the teachers and city side of the right to find city irregular teachers because of the recruitment process sequencing,contract signed by the regularization and the concept of teacher development, their choice of teaching, pay treatment right and professional training right got guarantee. Rural irregular teachers lack of the rights have caused serious negative influence for irregular teachers itself and the school in countryside.To explore the reasons behind it, we can from macro differences between urban and rural areas,medium preparation system and the angle of the micro individual capital to explain it.Researching the rural side lack of teacher's rights can provide us with some reflection and enlightenment. First of all, set up the education fairness idea and promote the balanced development of teachers. Fair education leaders should pay more attention to the teachers fairness. Secondly, draw lessons from foreign experience and improve the teachers' management system. Irregular teachers is not a unique phenomenon in China, we can draw lessons from foreign experience, the specification of irregular teachers employment contract. Finally,create cultural capital and change the logic of culture reproduction. Rural irregular teachers also should fully use the school and the power of the peer group and change their own destiny. Only by building up the idea, the education fair system reasonable teacher management system combined with irregular teachers own efforts, form three aspects together, can effectively guarantee the right of irregular teachers in rural areas.
