Research On Effects Of Think Tank On Legislative Construction In China

Think Tank is an important subject in the process of public policy and plays an indispensable role in the whole process of public policy.As the third plenary session of the 18 putting forward “strengthen the construction of new Think Tank with Chinese characteristics,establish and improve the decision-making consultation system” and the coming up of the important file “suggestion on strengthening the construction of new Think Tank with Chinese characteristics”,new Think Tank construction with Chinese characteristics was promoted to the height of national strategy,facing a new development opportunity.Currently,our country has entered a new history stage of the all-round construction of legislative China,the legal construction developed comprehensively and steadily,along with many difficulties and problems to be solved ahead.As an important emerging driver in international political,economic and social development,what kind of role the Think Tank will play in the process of our country's legislative construction? What problems will be solved,what feasible way will be choose? These are important issues in current research.However,domestic and foreign academic circles still lack enough attention on these questions,and there are few related research results.This article is trying to research deeply in three aspects of the legislative country,legislative government and legislative society.In order to offer better service for the Chinese legislative construction,firstly this paper studies the development of excellent Think Tank at home and abroad under the background of globalization,summarizes the important effect of the advanced Think Tank.Then deeply excavates Think Tank's function,such as policy recommendations,theory innovation,public opinion guidance,society service,public diplomacy,providing concept and practice reference for promoting the development of Chinese legislative construction.In addition,this article also objectively evaluates the achievements in the process of our legislative construction,analyzes the deficiency of real legislation quality,scientific decision-making and democratic participation at the same time.On this basis this paper puts forward Think Tank's feasible paths for legislative process.It mainly has following four parts.The first part systematizes the related theories about Think Tank and legislation through interdisciplinary research method,literature research method,comparative analysis method and experience summary method,introduces the cognition of Think Tank and legislation between Chinese and western scholars and the western Think Tank's function acting on the legislative progress in western countries.The second part based on the reality,analyzes the progress and the deficiency existing in Chinese legislation,points out the necessity of legislative Think Tank as a new way in improving scientific legislation.The third part mainly expounds Think Tank's function in containing the abuse of power and promoting decision-making system.Among them,“revolving door” mechanism's function in the supervision of legislative government in Think Tank is one of the highlights of this part.Finally,the role of Think Tank in the construction of legislative society begins with Think Tank's function in improving civil society,analyzes the role of Think Tank in the realization of legislative society,guiding the public thought,opinion,cognition by taking advantage of its unique platform.
