Study On Illegal Construction Management Under The Background Of New-type Urbanization

As an important foundation for modernization of our country,the New-type Urbanization is the route we must take to build a well-off society in an all-round way."The 13th Five Year Plan" was offcially issued and implemented last year,which marked that our country has entered into a crucial stage of the runoff of well-off society in an all-round way. As an experimental zone for "Urban Design Project" in Henan province,Resolution of Seven Meeting of Six Session of Luohe Municipal Party Committee acts'taking New-type Urbanization to create one district two city one center' as a long-term strategy and puts forward to use continuous power to optimize the upgrade, thus to achieve the deeply integration of informatization and industrialization in Central Plains Region, to coordinate urbanization with agricultural modernization, to achieve a synchronous development among New-type Urbanization, new industrialization,informationization and agricultural modernization.However, with the rapid development of urbanization, administrative region of Luohe is gradually expanded and large scale of relocation development projects are switched on,which caused rags-to-riches story happened on a number of suburban and urban village district residents. Driven by economic interests, large scales of people try to swindle land expropriation compensation through illegal construction. The rapidly spread of bad social morality and numerous illegal construction problems lead to mass disturbances. In the first quarter of 2017, there are 67 petition complaint cases about illegal construction, which account for more than 32.5% of all cases. That is why the government management of illegal construction task is heavier and the social development is beset with numerous contradictions. Therefore, under the background of urbanization, the illegal construction problem is one of prominent social problems at present.Taking Luohe city of Henan province as an example, this dissertation analyzes the illegal construction problems. The main methods are as follows: 1. Questionnaire and key forum on illegal constructions in Luohe. The content of questionnaire and forum is proposed by the author and relevant leaderships and working staffs in Luohe Urban and Rural Planning System. In the early stage, in order to seek suggestions, questionnaires are delivered to Real Estate Enterprises, Municipal Planning and Urban Management Law Enforcement Officers by exclusive interviews; besides questionnaires survey, key forums are launched among Urban Planning Bureau, City Land Bureau and Construction Commission, Construction Bureau and Urban Comprehensive Law Enforcement Unit of Yancheng District, Yuanhui District, Zhaoling District; in order to make sure the comprehensiveness of the research, the subject group had informal discussions with illegal construction litigants of neighborhood committees in Mengmiao Town, County Town, Heilongtan Town, Houxie Town, Ganhechen Town, Shabei Town.Based on researching recently statistics collected by Luohe Government, Aunicipal Governance Illegal Construction Leading Group and Illegal Construction Remediation,current situation and the existing main problems are summarized and analyzed with combining analysis on working information summery report and content of quarterly and annual report by Supervision and Law Enforcement Team of Luohe city as well as cases on managing illegal construction.3. Through consulting data, advanced experience and good practice on illegal construction in other domestic cities are analyzed, which can deeply analyze the problems existing in the illegal construction in Luohe city and put forward the countermeasures and suggestions.Governance illegal construction is a long-term and systematic work, it not only involves the legislative, executive, social and many other factors, it also closely relates with the internal and external environment of urban development. At the same time, this problem is one of the difficult problems bothering city administrators. Hoping that analysis on this dissertation can provide related references for city administrators, and can provide more theoretical support to scholars in academic area, and further enlighten the management of illegal construction and urban management.
