The Research On The Phenomenon Of The Contract Breach And The Land Abandonment And Its Prevention Countermeasures In Rural Land Circulation

As an important measure to promote the reform of rural economic system,China's rural land circulation system has significant effciency in promoting the new urbanization and structural adjustment,improving agricultural growth and farmers'income.But in early 2015,the rural land circulation has suffered a large area of destruction of contract breach and land abandonment in Hebei Province,Shanxi Province,Shandong Province and other land transfer practice.Land circulation system involves the vital interests of hundreds of millions of farmers,and grain security is related to national security,so resolutely striking the phenomenon of the contract breach and the land abandonment and promoting the orderly development of rural land circulation is related to the cause of socialism with Chinese characteristics.While promoting the rapid rural land circulation,it is urgent to pay attention to the causes of the phenomenon of the contract breach and the land abandonment,strengthen the policy guidance,protect the legitimate rights and interests of farmers,and improve the social and public services.Based on the phenomenon of the contract breach and the land abandonment in rural land circulation in China,this paper analyzes the concept of rural land transfer,land property right,the contract breach and the land abandonment,and the theory of Marxist land rent,economics of scale and game theory,and provides those theory as support.Taking the representative example of Hebei Province as an example,this paper studies the phenomenon of the contract breach and the land abandonment in rural land circulation in China.From constructing and analysing the contractor-farmer game model in the typical pattern of "leading enterprise plus cooperatives",the paper found that the law and compensation mechanism of contract breach,information service mechanism,the main interests regulatory mechanism is not perfect.The causes of these problems are mainly due to the low cost of legal compensation for contract breach,the lack of transparent and efficient public service mechanism and the low status of farmers that can not be guaranteed.Based on the deep analysis of the case of Hebei Province and the experience of China's Sichuan Province,Zhejiang Province,Shanxi Province and Tianjin rural land circulation innovation pattern,this paper puts forward some countermeasures and suggestions,from enhancing the legal cost of the compensation for contract breach,perfecting the functions of information and financial sercives,guiding and regulating the land transfer market and building the new rules of the game to protect the interests of the peasants,to curb and prevent the phenomenon of the contract breach and the land abandonment in rural land circulation.
