Practice And Research On The Disposalof Historical Homestead

Issuing the Certificate of Ownership of Rural Homestead is an Important Measure to Guarantee the Legal Rights and Interests of Rural Villagers.In order to clarify the ownership of rural homestead,to avoid property rights disputes,to the future distribution of rural homestead,lay a solid foundation,as well as the protection of national land acquisition and demolition work smoothly,the issue of rural homestead use warrants work without delay.The source of ownership is the prerequisite for obtaining the certificate of ownership of the rural homestead,but there are some homesteads in the rural areas because of the lack of ownership of various reasons,resulting in the inability to register,which is collectively referred to as the historical homestead.For a long time,due to policy,operational level and other reasons,making history of homestead difficult to dispose of.The existence of historical homestead led to the waste of rural land resources,because of its lack of maintenance leading to security risks,ownership is not clear can lead to homestead disputes.At the same time,the historical homestead has damaged the development interests of rural areas and their neighboring towns,worsened the living environment of residents and therefore seriously disturbed the process of rural construction and development.Based on the study of the relevant laws and regulations of rural homestead and summarizing their own work experience,this paper studies the practice and difficulty of the historical homestead in Ruian City,Zhejiang Province.The article is mainly divided into four parts: first,introduced the rural homestead and the history of the homestead of the relevant concepts;second,on the Ruian City historical homestead disposal of the relevant profiles;Third,the analysis of Ruian City,The difficulties and reasons encountered in practice.Finally,we summarize the experiences of Ruian's historicalhomestead disposal and put forward some opinions,so as to provide reference and guidance for the disposal of historical homestead.From the above research content can be obtained as follows,the disposal of the historical homestead,fill the approval procedures,can speed up the rural homestead is indeed the right to register and verify the work to ensure that the legitimate rights and interests of farmers is not violated,is conducive to the establishment of harmonious and stable rural Social order,help to establish a sound real estate registration system.
