In the urban and rural areas, Chinese market economy system occur to huge change in order to establish next of a socialist harmonious society, with urban and rural society has undergone changes. At the same time, the rights of rural land use right performance also produced changes. Farmers appeal to the land use right no longer limited to the realization of the right of residence, but also contain the land use right of capital profits, because of increasingly urgent demands. With economic development and rural land markets become increasingly, particularly stealth rural housing land transaction markets. This phenomenon tells to us the legal system under the existing rural housing land static management model has rigid in China, and does not fit the market economy requirements. Deposit on the Housing land research and study, many of researcher and professors focus on it.This article analyzes characteristics of current rural residential land property rights system. It contains residential land collectively owned by villagers use; strictly rural housing land transaction. This article also reveals the limitations of rural housing land property system. This system caused a lot of idle land resources in rural areas, and hindered the coordination of urban and rural development. The formation of stealth market also caused many problems. Therefore, the current rural housing land property rights system uphold and improve the orientation of Chinese basic economic system in conflict with the intensive use of land resources conservation conflict. This article analysis rural housing land transaction system of Yongchuan District of Chongqing City, the overall size of a small, transfer forms, large regional differences, problems are more irregular flow, trading disputes over property rights confusion, the low rate of transaction.Based on the above analysis, this article presents several suggestions of the rural housing land transaction system: First, to improve the rural residential land tenure system; second, full play to the market drivers, allowing homestead market turnover; final, clearly define the scope of Homestead. Related departments should as soon as possible in the policy document to guide and regulate the flow of rural residential land use right to act to promote the orderly flow of rural residential land use right.
