As a vast agricultural country,three rural issues including agriculture,rural areas and farmers keep plaguing China's economic development.However,land issues are the basis and core of three rural issues.Both the agriculture and rural economy cannot develop without land,and the fundamental factor of farmers lies in the land.The fragmentation and decentralization of Chinese lands as well as the traditional management seriously impede the agriculture's transfer to large-scale,modern and intensive operation.Since 1987,the No.1 document from the national central government and a number of Decision have put forward promoting moderate-scale management of farmland to increase the efficiency of agriculture and the income of farmers,and improving the land utilization efficiency as well as labour productivity based on the orderly transfer of rural lands for consecutive many years.The current land system in China is still the collective land ownership of long-term stability,which indicates to insist collective ownership of rural land under the“stabilizing,decentralizing,and enlivening” principles to improve the separation of the land tenure and managerial right.Based on these requirements,China intends to separate rural land rights(ownership rights,contract rights and land management rights),prompt the orderly transfers and moderate-scale management of rural lands.In this paper,the case named “541” land transfer of Maoping village in Sichuan province is a simple and effective one within the context of prompting orderly transfers and moderate-scale management of rural lands in China.Problems like the following need to be solved: How to trigger factors of production,maximize the farmers' benefits,make room for modern agriculture,and ease the contradiction between socialized big market and farmers' small-scale production in order to avoid the empty-shell of collective economy without changing the household contract responsibility system.Maoping village utilizes rural land stock cooperative system,the core of which is“stabilizing contract rights,enlivening management rights and clarifying ownership rights”.Besides,it also combines the land trust model,takes specialized cooperative organization as the mediator and introduce companies as the owner to push the “541”stock cooperative system,then forms an interests community including farmers,village collectives and companies.Such policies will stimulate the farmers to break through themarket,share both the risk and the profits in order to change the farmers to investors,change the dispersion into cooperation and change empty shell into entity to steadily increase the farmers' income.This paper reviews and summarizes the “541” land transfer case of Maoping village by relative theories and practices under the context of the development of land transfer.The structure is as follows: The first part introduces the research background,target,meaning,theories and current researches at home and abroad;The second part explains the the background of land transfer and the typicality of the case;The third part provides details of “541” land transfer case and analyzes the subject,object,equity and effectiveness;The fourth part explores the motive factors and effects.Finally,we summarize some key points in the land transfer in the western China: First,the public service form government sectors is the precondition and assurance of the orderly transfer of land;Second,the intervention and management of mediators could make the land transfer more effective;Third,it requires long-standing mechanism to protect the interests and rights in land transfer.
