The promulgation of the draft amendment to the rural land contract law means that the “three-rights separation” model of rural land in China will be established at the legal level.Under the mode of “three-rights separation”,agricultural land contracting and management rights are divided into contracting rights and management rights,the right to contract is still owned by the farmers,and the right of management can be transferred to the market.Rural land “three right separation” can guarantee the land contract right of farmers and improve the efficiency of land use.Moreover,it will also bring more property income to farmers.At present,there is no systematic stipulation on how to guarantee the right of claim for transfer price of rural land transaction.Scholars have put forward the countermeasures to guarantee the property rights of the farmers in land transfer process,such as agricultural commercial insurance mechanism,the farmland risk guarantee fund,the letter margin mechanism,the land intermediary system and so on.Buy analyzing the advantages and disadvantages of predecessors' research,and reference to the civil law of Taiwan about the land rent registration system,the registration system of the right of claim for transfer price of rural land transaction is proposed in this paper.This paper discusses how to construct this system,and hopes to ensure the realization of the property rights of farmers in the process of rural land transfer.
