Research On The Supervision And Countermeasure Of Family Animal Husbandry Illegal Coating Area In A County In Jiangsu Province

Land is one of the most basic resource for human beings,in which cultivated land are rare resources,therefore protecting these limited resources is maintaining lifeline of human existence.Law of the People's Republic of China on Land Administration clearly defines "Treasure,rational use land and effectively protect farmland" as a basic policy in China.It is confirming the legal status of the basic national policy of land in the form of legislation;furthermore,it is the first basic national policy that concepted into law.However,in recent years,with the economic development and living needs.large-scale household livestock and poultry breeding has emerged in rural areas to increase household income.Due to the complexity of the illegal subjects involved in such cases and the difficult handling,this illegal land occupation has become difficulty in the land supervision and control work of the national land department.This essay is aimed at proposing reasonable and effective enforcement as well as supervision strategy of land law to effectively solve the problem through research and analysis of this topic.This essay briefly introduces the natural conditions of a county in Jiangsu Province and the general situation of organizations,presents the workflow of investigation and handling of illegal cases and investigation of illegal livestock;also analyze the current situation of illegal occupation of livestock and poultry breeding in Jiangsu Province,and solutions to these issues are provided as well through literature analysis of domestic and foreign researches on land supervision.Based on this,the main reasons for the existence of such issues will be discussed in three aspects,the parties concerned,land departments and other government departments.Initially,speaking of the person concerned,the legal consciousness of them is weak,their understanding of ideas is not high,their age and education background is not very well.However,in order to meet the desire to increase family income,small-scale livestock and poultry breeding can only be carried out at home.Besides,in terms of laws and regulations.the family-owned livestock and poultry farming areas in basic farmland cannot be legally processed.Thirdly,from the government's perspective,the legal procedures for the occupation of livestock and poultry require multi-sector approval.What is more.the difficulties are existing in solving such problems from the parties,land department and other government department.As regarding to parties concerned,it is difficult to promote knowledge of relevant laws and regulations,find the issues,enforce the laws and handle the cases mentioned above.In the aspect of land department,it is not easy to carry out dynamic inspection,imperfect enforcement measures exist,enforcement environment is poor and laws and regulations are not well-developed.As to other government departments,governors do not attach much weight to these issues,weak linkages are among related departments,and livestock and multiple departments manage poultry breeding.At last,based on the analysis above and drawing lessons from the experience of other cities and counties,solutions to the illegal land occupation of family livestock and poultry breeding can be found as following.Specifically,the solutions are a centralized breeding model from plugging out,simplifying filing procedures,procucing corresponding policies,developing relevant laws and regulations,intensifying publicity these laws and regulations,improving daily dynamic inspections,clarifying land law enforcement supervision responsibility,and improving the accountability measures of the departmental linkage mechanism of departments.
