The solution of environmental problems cannot be completely dependent on the role of the government.Watershed governance cannot rely solely on the role of government entities.In recent years,it has been advocating the establishment of a multi-collaboration model that advocates multi-collaboration,consultation and co-governance.Along with the promulgation of the"Opinions on the Full Implementation of the River Chief System"issued by the General Office of the CPC Central Committee and the General Office of the State Council in 2016,the production of the river basin was promoted by a local government to a highly effective response basin.A new institutional model for problem governance.The river chief system is conducive to breaking the water management pattern in Kowloon.Solving the problem of river basin management is conducive to solving the problem of river basin management,and it also provides a new opportunity for public participation in river basin management.In the context of the full implementation of the river system,public participation in river basin governance is necessary.China continues to explore new models of river basin governance and rise to the legal level.The river length system is a new achievement of China's river basin governance model.The legal mechanism,due to the persistence of government-led governance concepts,the low environmental awareness of the general public,the lack of social public and the ability to participate in watershed governance,the public participation is still more formal.The limited nature of the organization and the unorganized participation lead to the current river basin governance work mainly focusing on the responsibility of the governments and administrative departments at all levels to determine the responsibility of the government and the administrative departments for the main responsibility of the river basin governance-the party and government are mainly responsible As the chief of the river,he is responsible for coordinating the various tasks of river basin management and completion.He prefers the role of the"internal circulation"of river basin governance,lacks the direction to expand and expand the role of the main body,and the lower level of public participation must be Vigorously play the role of public participation in river basin governance.At present,the problem of public participation in river basin governance is also an aspect of the river system to be improved.First of all,the legal support for public participation in river basin governance is vague,which is reflected in two aspects.First,the citizen's environmental rights are not clear,and the general public participation in watershed governance rights is insufficient.Second,it is an important form of public participation and an environment for public participation in relief.In public interest litigation,the scope of the main body of the plaintiffs litigation is restrictive.Specifically,the individual citizen has not been granted the qualification of the plaintiff of the environmental public interest litigation.The social organization as the plaintiff of the environmental public interest litigation also has very strict conditions.Secondly,the legal system of information disclosure in river basin governance needs to be further improved,which is reflected in the lack of operability of relevant laws and regulations on information disclosure and the lack of integrity and authenticity of information disclosure.Third,the channels for public participation in watershed governance are not smooth.Finally,the lack of incentives and safeguards for public participation at the government level is not conducive to promoting the active participation of the public.Drawing on the successful practices of the Rhine,the Penghu,the Tennessee River Basin,the Murray-Darling River Basin in river basin management,and the successful practices in China,the following countermeasures are proposed for improving the legal mechanism of public participation in river basin management under the river system:First,improve the legal support for public participation in river basin governance;second,improve the legal system for information disclosure in river basin governance;third,broaden public participation channels and clarify the scope of participation;fourth,improve incentives and safeguards for public participation;and fifth,enhance public participation in the river.A long-standing legal awareness.
