Study On The Legal Issues Of Classified Management Of Urban Domestic Waste In China

Environmental pollution is a global focus.In China,one of the environmental pollution phenomena is the "garbage siege".The "garbage siege" not only affects the living environment of urban residents,but also restricts the construction of a beautiful China and the green and sustainable development of social economy.It also brings heavy burden to the environment,delays the construction process of ecological civilization in China,and reduces the number of residents Happiness index.The problem of "surrounded by garbage" needs to be solved urgently,and the classification of urban garbage is one of the effective means of garbage treatment.Garbage classification is a continuous and complex project,which needs the participation of the whole society.In recent years,the state has issued a series of legal documents on the garbage classification system to promote the garbage classification work,and put forward the goal of basically completing the domestic garbage classification system in 2020 and comprehensively establishing the urban domestic garbage classification system in 2035.In order to achieve this goal,local laws,regulations and other normative documents have been issued,and garbage classification work has been carried out through local legislation.However,in view of the situation of domestic garbage in China,the output of garbage is larger than the amount of cleaning and transportation.There is a situation that domestic garbage can not be cleaned thoroughly,resulting in garbage accumulation.It is necessary to classify domestic garbage to reduce garbage accumulation,alleviate the phenomenon of "garbage besieging the city",and return the beautiful appearance of the city.Based on the relevant theoretical knowledge of law and management,taking the classification and treatment of municipal solid waste as the main line,this paper makes an empirical analysis on the classification of municipal solid waste in Shanghai and Lanzhou from the domestic perspective,and finds out the common problems in the classification of municipal solid waste in China after comparison.From the international perspective,the relevant systems of Japanese and German waste fine classification are studied,and their successful experiences are summarized for reference.Finally,some suggestions are put forward for the improvement of garbage classification in China: first,improve the legal system of urban domestic garbage classification from two aspects: strengthening the special legislation of garbage classification and improving the relevant laws and regulations of garbage packaging;second,improve the garbage treatment fee collection system and garbage treatment compensation mechanism to alleviate the financial burden;third,flexibly use the market-oriented governance In order to maintain the good order of MSW classification,we should perfect and implement the extended producer responsibility system.Fourthly,we should strictly enforce the law and establish an effective accountability mechanism,reward and punishment mechanism,and supervision mechanism.
