Analysis Of Collusion Behavior And Prevention In The Construction Projects Bidding

The development of bidding activities is conducive to optimizing the allocation of resources,increasing economic and social benefits,and improving the market economic system.However,in the actual bidding process,due to low probability of being found out,low degree of punishment and other factors,collusion of bidding occurred frequently.In particular,engineering projects are characterized by large amount of capital involved,long cycle and numerous stakeholders,once collusion occurs,it will seriously disrupt the market order and have a bad impact on the society.Therefore,it is necessary to strengthen the analysis and prevention of bid collusion in engineering projects.Firstly,this paper systematically sorted out domestic and foreign literature such as the collusion of bidding,calculation,causes and prevention.Secondly,the behavior mechanism has been analyzed,based on the game theory model from the two most common situations of collusion between bidders and bidders,collusion between bidders and tenderer.Finally,based on the database of China judgment documents network,using the grounded theory to collect,compare,and three-level coding,the "three non-systems" of the prevention of collusion in the bidding of engineering projects are obtained.Through verification,we arrive at the following conclusions:the key to effective prevention collusion is to take effective measures to change the environment and conditions faced by rational people,so that rational people can change from "want to do,dare to do,can do" to "do not want to do,dare not to do,can not do".The first measure is to improve the bidding ability of enterprises,enhance the positive guidance,strengthen the information disclosure,improve the credit network,and reduce the expected profit of collusion,so that rational people do not want to collude.The second measure is to strengthen the internal inspection of enterprises,increase the intensity of punishment,focus on the accountability of individuals and other measures,so that rational people do not dare to collude.The third measure is to constantly reduce the manipulated and artificially space by means of establishing a standardized process centering on the key links such as quotation,strengthening staff training and promoting electronic office,so that the probability of asuccessful collusion is close to zero.
