A Comparative Study Of The Guarantee Of Xixia Contracts And The Guarantee Of Han Contracts

China is a multi-ethnic country with the Han nationality as the main body.All ethnic cultural contracts are important part of the Chinese contract culture.In order to further improve the research on the development of ancient Chinese contracts,this paper compares and analyzes Xixia Contracts and Han Contracts from the perspective of contract guarantee.First of all,this paper gives a brief overview of the guarantee forms of ancient Chinese contracts and guarantee of Xixia contracts.Then,this paper compares the list of contents of the guarantee part in the Xixia contract and the Han contract,and specifically analyses the similarities and differences between the two types of contract in terms of guarantee.The similarities mainly include the basic functions of third-party participants and the diversification of third party participants'terms.Differences include contractual guarantee format and guarantee content.Finally,the paper further explores the essential causes of these similarities and differences.The Commonness of the Xixia Contract and the Han Contract originates from the admiration,study and introduction of the advanced Han contract culture by Xixia People.This article considers the inherent characteristics of the Xixia contract with respect to the Han contract.The ultimate cause of the characteristics is the further regulation of contractual relationship form the Xixia Code.
