Research On Grassroots Governance And Rule Of Law In Literature

The novel "I am not Mandame Bovary" portrays the grassroots officialdom ecology and the depiction of the plight of grassroots governance practices,which is a major "pain point" that touches readers.The grassroots level is an important subject of the rule of law,and it is the life practice of countless ordinary people who have achieved the rule of law.Therefore,through the grassroots level,we can see a face of the rule of law in China,and "I am not Mandame Bovary" provides a possibility to understand the operation of the rule of law at the grassroots level.The Third Plenary Session of the 18 th CPC Central Committee clearly proposed to promote the modernization of the national governance system and governance capacity,and the rule of law as an important direction of social governance modernization.Since the grassroots has no doubt about the significance of the state,how to achieve the grassroots rule of law is also the direction of this article.The writing logic of this paper is based on the novel "I am not Mandame Bovary" ,discovers the practical dilemma of grassroots governance,and analyzes the formation mechanism of dilemma,and then finds the path to achieve grassroots rule of law.Although another literature cannot represent the society itself,it is also a mirror of real life.After the rule of law becomes the context of the times,we can always look at the rule of law from literature.This article hopes to pass the interpretation of "I am not Mandame Bovary" ,to illustrate the importance of literary texts in legal studies,so that the study of law in literature can be further developed.The article is divided into five parts.The first part is the introduction.Firstly,it explains the reason of writing,that is,why it should be studied through literary texts.Then it combs and summarizes the academic research on the basic governance and the rule of law through literary texts.Finally,it explains why the novel "I am not Mandame Bovary" is chosen.Analyze the text to study grassroots governance and the rule of law,and pave the way for the interpretation of"I am not Mandame Bovary" .The second part,by expounding the novel "I am not Mandame Bovary" ,combined with the reality of reality,reveals the real dilemma of grassroots governance from the encounters of Li Xuelian,the government and the courts,that is,the public in law practice and law Gradually,grassroots governance loses credibility in inefficiency and incompetence,and there is a weak voice in the bureaucratic governance system.In the third part,today,when the rule of law enlightenment continues to gain social consensus,the dilemma of clearing the rule of law at the grassroots level cannot be simply attributed to the public’s resistance to the modern rule of law.The deeper reason is the influence of the bureaucratic governance system,that is,Grassroots governance is embedded in the government’s all-powerful governance concept,the administrative system of administrative contracting,and the hierarchical governance structure of the same responsibility.This leads to the complexity of grassroots governance,the intensification of grassroots conflicts,the inconsistency of powers and responsibilities of grassroots governments,and the weakness of laws.The problem has arisen,which has hindered the realization of the rule of law at the grassroots level.Especially under the administrative contract system,relying on the governance of indicators to achieve the governance of officials,so that local officials at all levels have to be tossed by Li Xuelian.The fourth part,aiming at the formation mechanism of the grassroots governance dilemma,and resolving the dilemma of grassroots governance,should implement the strategy of comprehensively governing the country according to law,and need to realize three transformations: the concept of governance changes from omnipotence to rule of law,to form a unified power,responsibility and authority.The rule of law government;the governance mode changes from administrative contracting to legal governance,to promote the rule of law at the grassroots level;the governance structure changes from the same responsibility to the rule of law,in order to seek a balance between central authority and local and grassroots effective governance.The fifth part mainly discusses some problems that affect the in-depth development of "law in literature" ,and then clarifies the possibility and limits of studying law from literature.
