A Study On The Legal Management Of Buddhism And Taoism In Song Dynasty

Religion is closely related to our life.Not believing in religion does not mean that it is not related to religion.As an important dynasty in history,Song Dynasty not only created brilliant culture,but also managed religion according to law,not only maintained its own ruling order,but also promoted the development of religious cause to a certain extent.Therefore,it is of great significance to study the governance of religion in Song Dynasty.Through sorting out the relevant historical materials,this paper restores the Song Dynasty government's effective management of the number of monks and Taoists through the establishment of religious management institutions,through the establishment of a certain procedure of becoming a monk,and also the control of the scale and number of temples,so as to control the religious power within a reasonable range,so as to maintain the rule of the Song Dynasty.In the process of sorting out the relevant laws of monks and Taoism in Song Dynasty,we found that these legal edicts also reflected the privileges of bureaucrats to a certain extent.A large number of Buddhist and Taoist legislation are almost criminal provisions,civil and other aspects are rarely touched.If according to the theory of Mein,the proportion of civil punishment in the law reflects the trend of law progress,there is no doubt that there is still room for the development of this aspect of law in Song Dynasty.At the same time,a large number of crimes committed by monks and Taoists were determined by reference to the relationship between ordinary people.In ancient China,where the law was deeply influenced by Confucian ethics,these Buddhist and Taoism legislation in Song Dynasty inevitably had traces of Confucian ethics.Even Buddhism and Taoism intended to learn from the ethical relationship of the secular world,so as to better meet the requirements of the rulers to develop themselves.If the legal movement is a process from identity to contract,there is no doubt that the Buddhist and Taoist legislation in Song Dynasty is still a kind of identity legislation,not only there is a hierarchical relationship within the temple,but also in the submission of Buddhism and Taoism to the secular regime.The emperor does not kneel down the God ofBuddhism and Taoism,and even Buddhism and Taoism beautify the emperor one after another.This paper also briefly compares the religious laws of other countries,and finds that the punishment of religious crimes in China is relatively light.To some extent,it shows the instrumental rational characteristics of Chinese Buddhism and Taoism belief,and the real belief may not have been established.Of course,we also see the positive changes brought by Buddhism and Taoism to the society,that is,it has a certain impact on people's legal psychology,and has a certain impact on the mitigation of punishment and the expansion of ethnic punishment.And enrich people's lives.
