The Study Of The Control Of "Persons With Three Illegal Behaviors" Under The Conflict Between The National Law And Local Law Practices

"Persons with three illegal behaviors" in this thesis are those foreigners illegal entry,illegal residence and illegal employment called by the public security organ in our country.The group of "persons with three illegal behaviors" are assuredly and widely exist in our country.This is always a one huge hidden trouble and challenge to our nation security and the maintaining of the security and order in our society and our boundary.Especially the areas of frontier minority people where exist numerous "persons with three illegal behaviors" suffer from a difficult control and a frequent phenomenon of "sent but back" because of varieties reasons of the typical and completed geopolitical reason,cross-border ethnic groups,historical conditions and the social economic and so on.This is a big threaten to the local society and the nation security.Nowadays,the researches on"persons with three illegal behaviors",especially the control study,hold a view of national perspective and paid more attentions to the legislation system and the law enforcement activities in border police in order to find problems and solutions.However,these researches are lack of taking account of the regional specific characteristic from the actual situation of local society.Most of the controls on "persons with three illegal behaviors" are came from the above to below and there lacks of reactions from the bottom to the top.In especial,the inhabitants of a border area who sink into this problem have no correct cognition of the"persons with three illegal behaviors",so they can not cooperate with the former control from country.So,getting to know about the real situation of"persons with three illegal behaviors" in local society and the effect they brought to the society and the cognition of the "persons with three illegal behaviors" among the inhabitants of a border area will benefits the study of the problem.According to this,the author chose Yunnan Changyuan Wa peoples Autonomy County,which share boundary with Wa State to do field survey.The author went embedded into the local society and study the flowing status of "persons with three illegal behaviors" in this area,and analyze the reason of repeated emergence of "persons with three illegal behaviors" in frontier minority people area and the effect from enforcement of national laws and policies in the control of"persons with three illegal behaviors".IN addition,this thesis shows a realistic "cross border marriage" case that related to the "persons with three illegal behaviors",through the experience of the illegal entry,illegal residence and illegal employment cross the boundary of China and Wa State from a woman who under the identity of the "persons with three illegal behaviors" to illustrate the control of "persons with three illegal behaviors" in this area and the realistic troubles and legal problems in their work.Furthermore,after the cross border marriage relationship was made,the woman got the change to get rid of the identity of "persons with three illegal behaviors".But there came new problems in the woman's life in China(such as procreating new generations,getting legal residence and citizen identity)that gives us a better understanding of the lankness in legal system and unavoidably problem in management in grass-root society.Finally,based on the case study,the author analyzes the defects and deficiencies of the national legal system and the enforcement of the law in local law enforcement agencies,put the problem of control "persons with three illegal behaviors" under the sight of national security outlook,reiterate the importance meaning of the control of "persons with three illegal behaviors" to security of national border and from both standpoint of national security and local needs put forward the author's own countermeasure and suggestion.
