Research On The Rural Elite Governance Ruled By Law

The Third Plenary Session of the Eighteenth Central Committee of the Party has taken “completing and developing the socialist system with Chinese characteristics,promoting the modernization of the state governance system and governance capability”as the overall goal of comprehensively deepening the reform.The promotion of the rule of law makes the grassroots democratic governance under the rule of law.So,how can rural elite governance into the orbit of rule by law has become the focus of the current rural work and the driver of the current rule of law.In the course of its implementation,it can bring some positive effects to the development of the countryside in the specific historical period,however,there are internal conflict between the rural elite governance and the rule of law,which will leas to the disorder of the rural.Therefore,the study about the rule of law in the village is imminent.This article takes the economic elite as the main research object,through the in-depth investigation of village A in S province,we can comprehensive display of the elite to participate in the whole process of the rural governance.Through the study of the decision-making of the elite from the participation in the election and all-round study of the failure of the governance lately,the author believes that the emergence of rural elite governance is the product including the current economic system reform,development of market economy and village autonomy system of the combination of the development.The villagers who take advantage in the economic,knowledge and experience have become leaders of the village,who can promote the economic development of village,increases the income of farmers and achieve public infrastructure construction.In the early of the rural elite governance,elites have played a positive role in promoting the peasants' political participation and the raising of the rights consciousness.However,there are many problems about the rule of law in the village,what's more,those means general a trend that running away with the rule of law and back to the rule of man.Such as there are conflicts between the concept of rule of man and the rule of law,the blame of personal centralization and the rule of law,the lack of power rent and the failure of rule of law.In the traditional concept,the peasants do not have a clear understanding of the rule of man and the rule of law,which leads to the villagers mistaken the rule of lawbecomes as a legitimate governance model.Through interviews,we can conclude that the current conflict between the rule of man and the rule of law is mainly the reason that the villagers' thinking inertia,clan concept and the role of its forces,the rule of law awareness and the weakening of its regulation,based on the analysis of the causes of the conflict between the rule of man and the rule of law,it is necessary to achieved the transformation from the the rule of man to the rule of law.The people in the process of governance in the process of the above problems and contradictions,we should take some effective measures in the aspects of the ideology,mechanisms,strategies and supervision,when the rule of lawbecomes have some problems.Concretely,it is necessary to cultivate the idea of the rule of law,realize the organic integration between the rule of law and the wisdom of the lawbecomes,enhance the ability of the rule of law to the village,and explore the new democratic supervision system.Under the conditions of the rule of law,we can be fully take the law becomes as example,promote the development of rural society,and achieve the rule of law in the village.
