Economic Law Analysis Of Government Purchasing Services

Government purchase service refers to the government will be hosted by the original social services through the "purchase" approach,by social organizations to undertake.Government procurement services as a new way to provide services,to reduce the financial burden of the government,give full play to the advantages of market competition,optimize the allocation of resources,to better serve the public.However,the effect of the system in practice is not very satisfactory.In some areas,the phenomenon of black-box operation and rent-seeking is the most important.The purpose of this paper is to make suggestions on the improvement of the system by studying the present situation and existing problems of the government's purchase serviceIn addition to the introduction and conclusion,this article is divided into four parts:The first part,“The Theoretical Basis Of Government Purchase Service Under The View Of Economic Law”.This part firstly introduces the concept of government purchasing service and three factors,including the subject,content and manner of purchasing service,and tries to define the legal relationship in government purchasing service.Then analyzes the economic law theory basis of government purchase service,including economic law regulation incentive theory,legal right interaction theory,government failure theory and social standard theory.The second part,“The Present Situation And Existing Problems Of The Government Purchase Service”.This section analyses the present situation of government purchasing service.Although our country has set up the corresponding laws and regulations and increased financial support,but the government purchase services still exist many problems,including the government purchasing service legal regulation is not perfect,lack of competition and remedy mechanism and supervision mechanism is not sound,lack of incentive mechanism on the economic law.The third part,“Outside Investigation Of The Legal Regulation Of Government Purchase Service”.This part mainly introduces the development course and the development pattern of foreign government purchase services,including the American model of PPM,"social contract" of the British model and the change of technological innovation pattern of New Zealand.On the basis of summing up the experience of foreign,this part puts forward the relevant model significance to our country,namely,perfecting the government purchase services related laws and regulations,strengthen the supervision of government purchase services,to undertake the main body ability.The fourth part,“Consummates Proposal Of The Government Purchasing Service”.This part for government purchasing service problems in our country,put forward to strengthen the government purchase of the service economy legislation,perfecting the government purchase services procedural requirements,strengthen the supervision of the government to buy services,strengthening the incentive and responsibility mechanism between the government and social organization's advice,so as to realize the purpose of government purchase services benign and orderly development.
