Constitutional Orientation And Practical Way Of Villager Autonomy

The villager autonomy,which began in 1980s,promoted by the two forces of farmers'spontaneous creation and state system supply,and has achieved remarkable results in the past thirty years' practice.However,with the deepening of practice and the structural changes in the rural society,there are multiple problems in the actual operation of villagers'autonomy.The real value and practice path of villagers' autonomy are often faced with difficult position.Derived from the logical and historical process of villager autonomy,we can find that the villager autonomy is developed in the transition period of economic system and political system of the state.Now,the historical process of the country has entered a new era.The reform of the economic system and political system,including the reform of the rural land system,has come to a major adjustment.Under this background,it is important that how to respond to the reform and how to adjust and improve the villager autonomyfpr the development of villager autonomy.In order to solve the problem of the development of villager autonomy,the meaning of villagers' autonomy should be fully understood.First,we need to go back to the meta point of system design to make a normative interpretation and institutional analysis of the constitutional orientation of villager autonomy.The 111st item of the Constitution establishes the attribute and orientation of villager autonomy.The law of Villagers Committee Organization stipulates the implementation mechanism of villager autonomy.Combined with the historical evolution of rural governance and the derivation process of villager autonomy,the constitutional orientation and implementation mechanism of villager autonomy are subject to the general logic of rural governance in the history of China.The villager autonomy in the governance structure plays a role in communicating with the country and citizens,and promoting the implementation of national laws and policies.Several obvious problems coubld be found by combing the practice of villagers'autonomy.Firstly,the system of villager autonomy designed by the Village Committee Organization Law has been failed to fully implement.Secendly,the practice of villager autonomy shows some regional differences.The above problems further reflected the dilemma faced by villager autonomy in the implementation environment,law system and autonomy ability.Due to the problems,the constitutional function of villager autonomy is hard to achieve effectively.The analysis of the constitutional orientation and implementation predicament of villager autonomy constitutes an important basis for grasping the degree of adjustment of villager autonomy.In order to promote the development of villager,We can take the following ideas.On the one hand,we should combine the overall concept of party leadership and the rule of law advocated by national governance as a theoretical reference for the improvement of the villager autonomy system.On the other hand,we can summarize and absorb the policy deployment and practice exploration of villager autonomy in recent years as a system for adaptation of the villager autonomy system.Then,There are three specific paths for implementation:promoting the standardization of villager autonomy,improving the operating mechanism of villager autonomy,and exploring the diversified modes of villager Autonomy.
