The Reform Of The Commercial System From The Perspective Of The Transformation Of Government Functions

Our old Enterprise registration system was formed in the planned economy era,with a strong planned economy era,too many pre-approval matters,too many restrictions on the government and too much intervention on the market.After the eighteen major,the reform of the commercial system came into being.Since 2014,the reform of commercial system has been promoted for nearly four years.The pre-approval matters have been greatly reduced,and the convenience of enterprises entering the market has also been greatly improved,which has greatly stimulated the vitality of the market and led to economic development.However,with the gradual progress of reform,many problems have been gradually highlighted.For example,the regulatory capacity of the regulatory authorities is not enough to cope with the sharp increase of market participants in a short time.The related supporting reforms are hard to catch up with,and the most basic legal protection is not yet perfect.In this paper,the author takes the transformation of government functions as the angle of view,carries on the analysis from the discharge pipe service "of the three aspects of the status quo and problems of the present stage of commercial reform,the main measures of commercial system reform to provide public services in enterprise registration,access to relax the threshold to strengthen the follow-up supervision and aspects are introduced.Part of the reform policy has encountered some difficulties in the real implementation of the process,also appeared in the reform process of decentralization is not thorough,the existing regulatory system and the subsequent market supervision,do not match the needs of the market exit mechanism is not perfect,the system of commercial and government departments to provide public service ability and some reform measures difficult to promote etc..Through the analysis of the causes of these problems,combined with the actual situation of the development of market economy in China,and puts forward some ideas,accelerate the "license separation" reform to further implement the decentralization;a clear division of responsibilities of regulators and explore scientific and effective supervision mode to establish supervision system to adapt to new market demand;matching reform and improve the market exit mechanism and credit information publicity system;enhance the application ability and service ability of new technology personnel to perform their duties to strengthen the service function of the government;the introduction of unified legislation and strengthen the judicial guarantee system reform and perfection of commercial legal basis of the countermeasures and suggestions.
