With the network of public opinion in recent years of explosive growth,such as "Yu Huan case" and "Peng Yu case" such cases in the trial or judgment will lead to a huge public opinion,and the courts at all levels in our country still take a passive way to deal with the crisis of public opinion,and the treatment effect is not satisfactory,so the final court is guide the initiative will lose the public,instead of being "public opinion" kidnapping trial independence,is not conducive to the construction of the rule of law.To study the public opinion disposal of Chinese courts in public crisis management,to fill up the shortcomings of the court's public opinion disposal at present,and look forward to improving the public's legal awareness and enhancing the authority of the court's trial.This paper uses the literature research as the theoretical basis,through the data collection to describe our court of public opinion characteristics and development stage,and analyze the current situation of the disposal of public opinion,combined with "Huan case" and "Xu Yuyu fraud" in two case studies,to analyze the reasons and lessons learned from foreign courts to prevent and deal with public op inion,through the above comprehensive analysis to find out the countermeasures to improve the ability to deal with the public opinion of the court.The article includes four parts: The first part is the first and second chapter.The first chapter is the introduction,which outlines the background and significance of the research,briefly introduces the research ideas and methods of the article,and puts forward the innovative points of the paper.The second chapter is mainly about the co ncept of public crisis,public relations,court public opinion and other concepts,and studied the basic theoretical basis of agenda setting,silent spiral and others.The second part includes chapters three and four.The third chapter is the general way,characteristic and effect analysis of court public opinion disposal in our country at present,from which we can find out the defects of the current disposal methods.The fourth chapter presents the court public opinion disposal in two cases and the two basic cases Case,development of public opinions,ways and effects of disposal,and comparative analysis to find out the experience and lessons learned.The third part is the fifth and sixth chapters.The fifth chapter is inspired by the analysis of the way foreign courts deal with public opinion.The sixth chapter puts forward the countermeasures and opinions on the improvement of the court's public opinion in our country in view of the aforementioned reasons,lessons and enlightenments.The fourth part is the conclusion,including the conclusions of this article and the outlook for the future.Through analysis and argumentation,it is concluded that after many years of practice,all levels of courts in our country can recognize the necessity of disposal and respond to the public opinion in the face of public opinion,but there are still some shortcomings in the effect of the public opinion disposal.Generally speaking,public opinion Sensitiveness is not high,public opinion disposition initiative,did not establish a systematic response mechanism,overall planning awareness,daily publicity is not in place.In view of these problems,combined with the experience of foreign courts in dealing with public opinion,it is suggested that courts in our country should establish early warning and coping mechanisms for public opinion and public opinion,intensify the management of their own media,enhance the level of communication among judges,proactively set agenda,create positive images through literature and art works,Courts deal with the efficiency and quality of public opinion.
