An Analysis On The Legal Thought Of "Qian Fu Lun" By Wangfu

Wangfu(about 78-165),a famous thinker in the Eastern Han Dynasty,has been widely known for his great work“Qian Fu Lun”.He after the Eastern Han Dynasty by the tide of the history stage Chapter emperor to Constant emperor,which from the heyday to have sunset fading,because of the serious social conditions of the produce of pessimistic mentality of the Confucian moral thought,so his legal thought has assimilated the ideas of Confucianism and Taoism and it is compatible.With Confucianism as its core,and other various long especially legalists to fill the shortage of Confucianism,the mix together at the end of the Eastern Han Dynasty for the reform of his unique malpractices of the disadvantages of legal thought.Because of the political and economic environment,his thought both inheriting and developing the idealist spirit of Confucian ethical law,meanwhile,it also strengthens the thought component of the legal concept.It is characterized by the combination of idealism and utility and has an influence on the legal thoughts and governance of the later generations.This paper consists of three parts: introduction,text and conclusion.The introduction part focuses on Wangfu's life and his writings on the content of legal thoughts,summarize the research results and the significance of the topic selection.The body part is the core content of this paper,mainly discussed from the following three aspects:The first part is to discuss the theoretical basis of legal thought in Wangfu's theory,including the historical background and philosophical basis of the formation of Wangfu's legal thought.This part tries to explore the various factors that influence the formation of the legal thought of Wang fu.Secondly,discusses in detail the law theory of Wang fu'work,this is the core of this article.This part mainly includes the relations of king and people,the relations of moralization and penalty,rewards and punishments,bureaucracy.we discussed Wangfu's distinctive relationship of the monarch and peoples mainly from the purpose of setting the king,the relationship between the god's meanings and people's meanings,the close relationship between the king's safety and the people's economic status.The relationship of morality and penalty we can trace back to forefather's views,and we discuss Wangfu's complementation of the morality and penalty: thepenalty is put up before the moral education and the rule of law is the premise of the moral education.The discussion of the rewards and punishments is from the social status of middle and late period of Eastern Han Dynasty.From these discussions we concluded Wangfu's complementation of the morality and penalty of grand prize and heavy penalty,as well as the ideas of official selection and performance evaluation.Thirdly,analyzes the historical value and the modern significance of the legal thought on the Eastern Han Dynasty and the succeeding dynasty.Wangfu's thoughts on the election and assessment of officers in the Eastern Han Dynasty have enlightening value,even for the contemporary official management.His obvious weight law thought has a certain impetus to the subsequent dynasties.The idea of pardoning and punishment has certain reference price to the world and to the later generations.
