In recent years,campus bullying of minors has occurred from time to time,but up to now,there is no legal definition of campus bullying in our country,which is not conducive to the identification of campus bullying.In addition,in dealing with such incidents,the minor who constitutes a crime is punished or given administrative punishment.For minors who cause serious consequences but are not at the age of criminal responsibility,can only be imposed by the school,or by the parents to resolve,without any legal liability.On the other hand,other countries and regions,such as the United States,Germany,Japan and Taiwan,have already solved this problem,that is,to educate and punish minors who commit crimes and have serious misconduct through protection and punishment.The core of the protective punishment system with thenature of penalty substitution measures lies in the protection and education of minors,and at the same time,it has the function of punishment.By comparing the protective punishment system in some foreign countries,combining with the basis of domestic theory and practice,and dealing with the plight of campus bullying of minors,it is both feasible and necessary to introduce protective punishment.By introducing the system of protective punishment into the criminal law of our country,we can apply it to the minors who meet the requirements,and then achieve the purpose of regulating the bullying behavior of minors on campus by the criminal law.So that it can be applied not only to campus bullying,but also to minorsundefined bad behavior,serious bad behavior or criminal behavior.
