Investigation Report On Criminal Trial Of Bullying On Campus

Campus bullying seriously affects the physical and mental health of teenagers,and even some bullying behaviors are suspected of illegal crimes.With the increase of bullying on campus and bullying crimes on campus,it is necessary for us to summarize the trial experience of bullying crimes on campus,deepen the current situation of bullying crimes on campus,analyze the causes of crime and weak links in the trial process,and put forward practical countermeasures and suggestions on this basis.The author investigated the criminal cases of bullying on campus from 2015 to 2019 in H county of Henan Province by means of case review,field visit and case analysis.This paper makes a comprehensive analysis of the trial situation and trial effect,summarizes the experience,finds out the deficiencies,and puts forward feasible countermeasures and suggestions in turn.The specific structure is as follows:The introduction part introduces the concept of campus bullying,the realistic background,the juvenile judicial trial policy,as well as the research significance,research objects and methods of this paper.This part lays the foundation for the first and second chapters.The first chapter is the analysis of H County Campus bullying cases.This part takes the bullying cases in H county from 2015 to 2019 as samples,and makes statistical analysis from the basic situation and trial situation of the cases,and further analyzes and summarizes the causes.This part is the key chapter of the article.The second chapter is the analysis of the trial effect of bullying cases in H county.This part summarizes the achievements of judicial governance from the aspects of ensuring the litigation rights of the juvenile defendants,strictly verifying the age of the juvenile defendants,integrating the trial process of teaching in trial,scientifically constructing the systematic project of preventing juvenile delinquency,etc.This part is the key chapter of the article.The third chapter is the analysis of the problems and causes of the bullying cases in H county.Through the analysis,the author combs out the problems existing in the judicial personnel under the pressure of closing the case,such as the phenomenon of handling the case,the poor connection between the pre-trial procedure and the post courtassistance,the lack of legal aid,the single reasoning form of the judgment,the communication barrier between the single parent and the left behind family minors,the value conflict between the closed trial and the public sentencing,and analyzes the reasons from the social and court levels ?The fourth chapter is the countermeasures and suggestions for the trial of bullying cases on campus.In view of the problems existing in the trial of campus bullying cases,the author puts forward the necessity of campus bullying legislation in terms of legislation,concept and measures,establishes the concept of campus bullying legislation centered on rights protection,clarifies the rights and responsibilities of families,schools and state institutions,establishes a stable professional trial team,and implements the trial principle of active prevention We should strengthen the connection of trial and procedure,improve the quality and effectiveness of bullying legal aid and psychological support,strengthen the reasoning of judicial documents,integrate resources to care for single parent families and left behind minors,and explore appropriate information disclosure system.This part is the innovation of the article.
