The Research On The Interrogation Of The Elderly Suspects

According to the second provisions of the law on the protection of the rights and interests of the elderly in People’s Republic of China,the elderly refer to the citizens over 60 years old.Based on the above provisions,the crime of the elderly is the act prohibited by the criminal law that has been carried out by the people over sixty years.This article is based on the crime cases of elderly people collected in the field investigation,analyzing the characteristics of the old people’s crime and the factors that affect the crime.This paper also analyzes the physical and mental characteristics of the elderly suspects with the knowledge of psychology.At the same time,we focus on the research on the confession psychology of the suspects in the interrogation.On the basis of the analysis of the psychological characteristics,confession barriers and psychological characteristics of the criminal suspects in the interrogation,this paper puts forward the Countermeasures for the interrogation of the elderly suspects,in order to help and promote the related work in reality.Specifically,this article is composed of five parts.The first part is the research survey.This paper mainly introduces the research background,methods,significance,and the research achievements of the elderly crime at home and abroad.At present,with the advent of the aging population structure in the world,the problem of the crime of the elderly has been studied by a large number of in-depth research abroad,and more attention is paid to the analysis of criminology based on the empirical investigation.Whereas,the domestic research on the problem of the crime of the elderly is lack and weak which focuses more on the theoretical analysis and case study,while,neglecting investigation and scientific research.The second part is about the characteristics and influencing factors of the elderly crime.At present,the characteristics of the crime of the elderly in our country are as follows: the type of crime from concentration to diversification,the means of crime tending to be violent,concealed and intellectualized,and the objects of the crime be acquaintances and the weak.This part,based on Reckless’ s containment theory,discusses the reasons for the crime of the elderly,mainly including the causes of physiological aging,the weakening of psychological barriers,the fracture of emotional support system and the inducing of social environment factors.The third part is the main characteristics and psychological characteristics of the elderly suspects.At present,our country’s elderly suspects are mainly men aged 60-67 years old,whose cultural level is generally low that most are below the junior high school education level.In cognition,the seniors’ perception and memory decline and their thinking activities tend to be narrower and bigotry.They are mostly emotional in-stabled and negatively.Their will character are in low weak control.The fourth part is the psychological analysis of the elderly suspects’ confession during interrogation.The psychology of the criminal suspects in the interrogation is mainly characterized by three aspects,including the cognitive deviation of the nature of the behavior,the control of the negative emotion and the will of the confession of the interrogation.As to the confession obstacle,dreading punishment,fluke and alert are the three main types.The fifth part involves the trial of the game theory.This part,starting with the elderly suspects,aims at the characteristics of the elderly suspects.From the selection of the interrogator,the choice of the interrogation breakthrough,the adoption of the interrogation countermeasures and the application of the law,it proposes three flexible breakthrough : details of the case,psychology and the evidence.At the same time,the following strategies can be adopted to guide the successful implementation of specific trials: emotional impact,combination of fighting and pulling,sequential promotion,combination of virtual reality and direct attack.
