After three years of efforts and exploration,the national court has generally completed its first stage of the judge system reform.Its basic reform system has landed.But a series of legacy problems in the post reform era are being highlighted.President of the Supreme People's Court Zhou Qiang pointed out:"After the reform of the system of judge posts,there are some prominent bottleneck problems in the transition process of the new and old handling mechanism,which is not conducive to the long-term development of the reform,which has seriously affected the timely release of the reform dividend.” It is imminent and imperative to solve the left-over problems.Based on the above consideration,this research adopts the literature research method,the empirical investigation method,the statistical analysis method and the comparative study method,taking the system running status of E City,N Province as the investigation object.looking up the existing problems and causes of the reform of the post system,combining the theories of management and human resource management,and drawing lessons from the management of judges at home and abroad,we put forward the perfect countermeasures for the left-over problems of the system of judge posts.The full text is divided into seven parts.The introduction introduces the research background and significance,the research status quo at home and abroad,and the research train of thought,content and method.The first chapter is the summary of the system of judge posts,expounds the objectives and tasks of post system reform,and focuses on sorting out its connotation,background,theoretical basis and practical significance.The second chapter describes the present operating situation of the system of judge posts of E City ' s intermediate court through the number of judges,the selection mechanism of the judges,the operation and supervision mechanism of the judicial power,the mode of division of judges,the assistants of the judges,the clerks,the assessment mechanism of the judges.It finds out the problems and causes and paves the way for promoting the reform.The third chapter is about the problems and causes of E City's post system.The remaining problems and causes of posts in E City's intermediate court are analyzed empirically.First,the number of "top layer design" lacks scientific and effective basis,and the court "soft confronts" and dissimilates the reform goal.Secondly,the judge selection mechanism fails with the young people's quota "lying down on the spot".Thirdly,the connection between the responsibility system and the post system is not enough and the judges' right,responsibility and profit mismatch.Fourthly,the right and responsibility of the judge and the judge ' s assistant are not clear,which deviates from the reform orientation.Fifthly,the mechanism of assessment is rigid,and the judges only enter and don ' t go out.The fourth chapter is about how to promote the reform of judge's post system through investigating the relevant system of judge management at home and abroad.In the fifth chapter,the paper takes E City ' s intermediate court as an example and puts forward the perfect methods of the post system.First,use the quantitative prediction method of human resource demand to set up the number of judges scientifically.Secondly,use the post competency model to improve the selection mechanism of the judges.Thirdly,deepen the reform of the judicial responsibility system and unify the judges' power and responsibility.Fourthly,establish a reasonable division mechanism for judges,judge's assistants and clerks.Fifthly,use “cases weight" model to scientifically assess the performance of judges and establish the dynamic adjustment mechanism of posts.Sixthly,improve the judge's occupational security system.The sixth chapter is about the conclusion and the prospect.This chapter,taking the E City intermediate court as an example,expounds the conclusion of the improvement of the left-over problems and makes an objective analysis of the shortcomings in the study,and determines the direction and theme for the follow-up study.
